Warta participates in the BLS (Bezpośrednia Likwidacja Szkód – Direct Claims Settlement) system. Policyholders who are victims of accidents caused by drivers insured with other BLS-member insurers may report the claim directly to Warta instead of pursuing the at-fault driver's insurer. The optional add-on product 'OC Szybka Wypłata' (C6331) extends this capability with a PLN 500,000 per-event limit for vehicle damage claims.

Bodily Injury Liability

Covered

Civil liability of the vehicle holder and/or driver for bodily injury, death, personal injury or health impairment caused to third parties in connection with the movement of the vehicle. Warta's liability is limited to the statutory guarantee sum, which must not be lower than PLN 29,876,400 per event regardless of the number of victims (equivalent to EUR 6.45 million, applicable from 6 November 2024).

Property Damage Liability

Covered

Civil liability of the vehicle holder and/or driver for loss, destruction or damage to property of third parties caused in connection with the movement of the vehicle. Warta's liability is limited to the statutory guarantee sum, which must not be lower than PLN 6,021,600 per event regardless of the number of victims (equivalent to EUR 1.3 million, applicable from 6 November 2024).

Green Card (International Insurance Certificate)

Covered

The MTPL policy covers events occurring on the territory of Poland and on the territory of states whose National Bureaux are signatories to the Multilateral Agreement (Green Card system). Border OC applies in EEA member states and Switzerland. For damage caused in countries other than Poland where coverage applies, Warta is liable up to the guarantee sum set by that country's regulations, but not less than the Polish statutory minimum.

Roadside Assistance (Standard)

Assistance Standard is included as standard with the base OC policy. It provides help exclusively in the event of an accident (not breakdown), including towing to a designated workshop up to 100 km from the scene of the accident within Poland, informational assistance, and message relay. Higher-tier variants (Złoty, Złoty+, Platynowy) covering breakdowns, theft, and other events are available as paid optional add-ons.

Key conditions

territorial_scope

The policy covers events on the territory of the Republic of Poland and on the territory of states whose National Bureaux are signatories to the Multilateral Agreement (Green Card system). Border OC covers EEA countries and Switzerland. For damage abroad, Warta's liability is limited to the guarantee sum prescribed by the laws of that country, but not less than the Polish statutory minimum.

The standard MTPL policy issued by Warta serves as proof of insurance in all countries participating in the Green Card system (Multilateral Agreement signatories). For travel in EEA countries and Switzerland, border OC applies if the policyholder does not hold a valid domestic OC policy or Green Card. For damage caused in other signatory states, Warta is liable up to that state's minimum guarantee sum, at least matching the Polish statutory minimum.

driver_restrictions

The statutory MTPL policy covers liability of the vehicle holder and any driver operating the vehicle. Warta has the right to seek recourse from the driver who caused damage if the driver: (1) intentionally caused the damage, was under the influence of alcohol, drugs or intoxicants; (2) obtained possession of the vehicle through a criminal act; (3) did not hold the required driving licence; (4) fled the scene of the accident.

claim_notification_deadline

Under the base MTPL policy, the insured must notify Warta promptly of any claim event and provide all necessary information. The insured must also inform Warta in writing within 14 days of any transfer of vehicle ownership. For the optional OC Szybka Wypłata add-on (C6331), the claim must be reported no later than 7 days after the incident via Warta's Customer Service Centre (COK).

bonus_malus_rules

Warta applies a bonus-malus system to MTPL pricing. The premium is adjusted based on the policyholder's claims history, which Warta retrieves directly from the Insurance Guarantee Fund (UFG) database for vehicles registered in Poland. Foreign claims history can be taken into account if the policyholder submits a 'Certificate of Insurance History' in the format prescribed by EU Implementing Regulation 2024/1855 of 3 July 2024. The specific bonus-malus scale and discount/surcharge percentages are determined individually at the time of policy issuance based on claims experience.
