Third-Party Bodily Injury Liability

PLN 29,876,400

Covers financial consequences of bodily injury, health impairment or death of third parties caused in connection with the operation of the insured vehicle. The guarantee sum is set by the Compulsory Insurance Act (Ustawa OC) and is currently PLN 29,876,400 per event for personal injury claims. The sum is identical across all three variants (I, II, III) of the OC policy. ERGO Hestia pays compensation to the injured parties up to this statutory guarantee sum.

Third-Party Property Damage Liability

PLN 6,021,600

Covers financial consequences of property damage caused to third parties in connection with the operation of the insured vehicle. The guarantee sum is set by the Compulsory Insurance Act (Ustawa OC) and is currently PLN 6,021,600 per event for property damage claims. The sum is identical across all three variants (I, II, III). ERGO Hestia pays compensation to injured parties up to this statutory guarantee sum.

Legal Assistance (Telephone Legal Adviser)

Telefoniczny Asystent Prawny is available in Variant II and III of the OC policy. It provides up to 12 telephone legal advice sessions per insurance period covering issues related to the insured vehicle (claims, traffic offences, licence suspension, registration matters, Compulsory Insurance Act provisions). The guarantee sum for this service is PLN 2,000. Not included in Variant I. The service is available 24/7 per the official product page.

Green Card (International Motor Insurance Certificate)

The Green Card document is issued as proof of compulsory motor third-party liability insurance valid in Green Card system member countries. The statutory OC coverage extends abroad to countries participating in the Green Card system. The OWU sources do not explicitly price or quantity this separately; it follows the statutory guarantee sums. Issuance of the Green Card document and its exact territorial scope are governed by the Compulsory Insurance Act and PBUK rules.

Roadside Assistance / Vehicle Towing (within OC add-on)

Towing service (Holowanie pojazdu) is included as an optional add-on in Variant II and III of the OC policy. It covers organisation and costs of towing the insured vehicle and vehicles involved in an accident caused by the insured driver on Polish territory, up to 150 km per vehicle. The guarantee sum for this service is PLN 2,000. Not available in Variant I. A separate Car Assistance product (with broader coverage across Europe) can also be purchased as an add-on.

Driver Accident / Personal Accident for Driver

Personal accident coverage for the driver (NNW Kierowcy i Pasażerów) is a separate, distinct insurance module within the ERGO 7 package and is not part of the MTPL (OC) policy. It must be purchased separately as an optional add-on. The OC policy itself does not cover personal accident benefits for the at-fault driver.

Passenger Accident / Personal Accident for Passengers

Personal accident coverage for passengers (NNW Kierowcy i Pasażerów) is a separate insurance module within the ERGO 7 package and is not part of the MTPL (OC) policy. It must be purchased separately as an optional add-on. The OC policy covers third-party bodily injury claims (including passengers of the at-fault vehicle) as liability claims, not as personal accident benefits payable to the insured's own passengers.

Key conditions

Territorial scope

The OC policy covers damage caused in connection with the operation of the insured vehicle registered in Poland, in accordance with the Compulsory Insurance Act (Ustawa OC of 22 May 2003). Coverage extends abroad to countries participating in the Green Card system. The policy document (OWU) is governed by Polish law.

Green card rules

The Green Card (Zielona Karta) document is issued as proof of compulsory motor third-party liability insurance in the Green Card member countries. The statutory guarantee sums set by the Polish Compulsory Insurance Act apply. The exact list of countries and rules for cross-border coverage are governed by the Ustawa OC and the Polish Motor Insurers Bureau (PBUK).

Driver restrictions

There are no additional driver restrictions beyond those set by the Compulsory Insurance Act. Coverage excludes damage caused by a driver who was under the influence of alcohol (state of intoxication: BAC >0.5‰ or breath alcohol >0.25 mg/dm³; state after alcohol consumption: BAC 0.2–0.5‰) or narcotics, if this had an effect on the damage. Exclusions under §23 of OWU apply to the additional voluntary coverages bundled with OC (Variants II and III), not the core statutory OC liability.

Claim notification deadline

The insured must notify ERGO Hestia of any loss event promptly (niezwłocznie) after the event or upon learning of it (§33 OWU). ERGO Hestia pays compensation within 30 days of receiving the notification. If circumstances cannot be clarified within 30 days, payment of the undisputed portion must still be made within 30 days, with the remaining amount due within 14 days of clarification. Claims can be filed via the iHestia portal, online form, post, agent, or by phone: 801 107 107 / 58 555 5 555.

Bonus-malus rules

ERGO Hestia applies a bonus-malus system based on insurance history. The premium reflects the insured's prior claim history with ERGO Hestia. Optional add-on 'Ochrona Utraty Zniżki OC' (No-Claims Discount Protection for OC, available in Variant III) protects the insured's current discount level: if one claim is made during the OC insurance period, ERGO Hestia will maintain the current claims-free record level when calculating the next year's premium. Continuous claims-free renewal (no claims in the immediately preceding contract, or gap no greater than 30 days between contracts) qualifies for bonus continuation (§51 OWU).
