AXA Belgium directly pays indemnities to injured third parties (victims) under the mandatory RC/MTPL coverage. For repair costs under the Assistance Réparation service, AXA pays the garage directly when an AXA-approved garage is used. AXA does not pay the policyholder directly for third-party liability claims; it settles directly with the claimant.

Bodily Injury Liability

Covered

Coverage for bodily injury caused to third parties (including passengers and vulnerable road users) as a result of the use of the insured vehicle in traffic. Coverage is unlimited per claim as required by Belgian law (Act of 21 November 1989). Also covers innocent victims under Article 29ter and vulnerable road users under Article 29bis of the Act of 21 November 1989.

Property Damage Liability

Covered

Coverage for material damage caused to third parties, including damage to clothing and personal luggage of passengers of the insured vehicle. Limited to EUR 129,550,508 per claim, including personal baggage and clothing of passengers. Does not cover damage to the insured vehicle itself, goods transported for professional and remunerated purposes (except clothing and personal luggage of transported persons), or damages resulting from participation in authorised speed, regularity or skill races.

Green Card / International Insurance Certificate

Covered

The green card (certificat d'assurance / verzekeringsattest) is issued as proof of the mandatory RC/MTPL coverage for the designated vehicle. It is valid in all countries listed on the certificate and ceases to be valid upon termination, cancellation or suspension of the contract. Roadside Assistance (Première Assistance)

Covered

Included free of charge in the base RC/MTPL premium (for cars, vans, minibuses, motorhomes and motorcycles up to 3.5t MAW, not for 'other vehicles'). Covers towing, return home or continuation of journey for non-injured occupants (max EUR 125), initial 24-hour rental vehicle (category B) if the vehicle cannot be repaired immediately, and psychological assistance. Valid in Belgium and within 30 km beyond Belgian borders. Not available for breakdowns or wrong fuel. Extended optional paid Omni Assistance or Assistance Véhicule available for breakdown and abroad coverage. Reimbursement capped at EUR 250 for towing/rescue not organised by AXA (EUR 500 if towed directly to designated garage via F.A.S.T. after police intervention).

Driver Accident Coverage (Sécurité du Conducteur / Veiligheid van de Bestuurder)

Optional

Bodily injury coverage for the driver is NOT included in the base RC/MTPL premium. An optional 'Protection des Personnes' (Bescherming van Personen) add-on is available in two modes: lump-sum (forfaitaire) or indemnity (indemnitaire, limited to EUR 1,500,000 per claim). Available for cars, vans, motorhomes and motorcycles. The indemnity formula covers medical costs, temporary and permanent disability (only incapacity > 10%), and death.

Passenger Accident Coverage

Covered

Bodily injury to passengers is covered under the mandatory RC/MTPL coverage as a third-party liability claim (passengers are considered third parties for RC purposes). Clothing and personal luggage of passengers is also covered. Under the EURO+ extension (included with RC), passengers injured in Western Europe accidents receive indemnification equivalent to Belgian law standards. Optional 'Protection des Personnes' in the 'FAMILIALE OCCUPANTS TOUT VEHICULE + TIERS DANS LE VEHICULE DÉSIGNÉ' formula extends personal accident coverage to all persons in the designated vehicle.

green_card_rules

The green card (certificat d'assurance / verzekeringsattest) is issued at contract inception and at each renewal as proof of the mandatory RC/MTPL coverage. It is not valid if the contract is cancelled, terminated or suspended. Coverage applies only in the countries listed on the certificate. The EURO+ guarantee provides top-up indemnification for bodily injury suffered in Western Europe to ensure Belgian-law-equivalent compensation. A bail bond up to EUR 62,000 is advanced by AXA for the designated vehicle and all insured persons when required by a foreign authority to lift seizure of the vehicle or release the insured on bail after a claim in a listed country (other than Belgium).

driver_restrictions

The policy covers the designated vehicle and all persons authorised to drive it. The contract must list the principal driver (and any regular occasional drivers). Key restrictions include: (a) AXA has a right of recourse against the policyholder if the vehicle is driven by a person under the legal minimum driving age in Belgium; (b) recourse if driven without a valid driving licence; (c) recourse if driven during an active Belgian driving ban; (d) recourse for driving under alcohol intoxication >0.8g/l blood or under the influence of drugs/narcotics. No right of recourse for driving infringements abroad that comply with local law. The Joker (no premium increase after first two at-fault claims) is available and ceases permanently after an accident involving aggravating circumstances such as drunk driving, intentional misrepresentation, fraudulent claim, deliberate damage, driving without or during suspension of licence, hit-and-run, or non-payment of premium.

claim_notification_deadline

In the event of an accident, the insured must notify AXA as soon as possible and within the deadlines specified in the contract: (1) Within 24 hours for theft, attempted theft, vandalism or theft of keys/remote controls; (2) Within 8 days for all other claims (including accidents). For the Replacement Vehicle guarantee, accident claims must reach AXA within a maximum of 3 working days from the date of the loss in order to optimise the replacement vehicle duration. Claims can be submitted via the broker, online at www.axa.be (My AXA client space) or by calling the assistance line. For EURO+ claims, notification must occur at the latest upon return to Belgium. For legal protection (Protection Juridique) claims, the claim must be reported to Legal Village S.A. (Rue de la Pépinière 25, 1000 Brussels or declaration@legalvillage.be).

bonus_malus_rules

The RC/MTPL and Dégâts Matériels (Accident) premiums for cars and vans are personalised based on claims history (bonus-malus system). Two parameters apply: (1) Number of claim-free years (schadevrije jaren): ranges from 0 years (130% of base premium) to 5 or more years (100% of base premium); (2) Number of at-fault claims in the last 5 years: ranges from 0-1 claims (100%) to 4-5 or more claims (412.5%). The final premium = base premium × years-without-claim % × claims-in-5-years %. The Joker neutralises premium increases for the first 2 at-fault claims when subscribed. The Joker is permanently lost after a claim involving aggravating circumstances (drunk driving, intentional misrepresentation, fraudulent claim, deliberate damage, driving without/during suspension of licence, hit-and-run, non-payment of premium/suspension, unauthorised racing). The Joker is regained after 5 consecutive claim-free years following a claim that triggered a premium increase.
