Direct payment

In the event of a loss caused by another party, the policyholder may report the claim directly to ERGO Hestia under the Direct Claims Settlement (Bezpośrednia Likwidacja Szkód) scheme, without contacting the at-fault party's insurer.

Own damage (partial and total loss)

Covered

AC Maxi (AC Uszkodzenie i Kradzież in the current OWU I-KDir-YCD-01/25) covers loss, destruction or damage to the vehicle resulting from: collision with other vehicles; sudden contact with persons, animals or objects; vandalism; collision of sports equipment carried on an external rack with outside objects; fire, explosion, flooding and sudden forces of nature; sudden thermal or chemical action from outside; theft. Both partial damage (szkoda częściowa) and total loss (szkoda całkowita) are covered. The sum insured equals the vehicle market value (Eurotax) at policy inception and adjusts with market value changes during the policy year. Available in three settlement variants: Kosztorys (cost estimate, alternative parts, labour rate PLN 65/h), Sieć Partnerska (partner network, alternative parts, max PLN 110/h) and ASO (authorised dealer, original parts, average local ASO rate). Minimum claimable damage is PLN 500 gross.

Total loss

Covered

Total loss (szkoda całkowita) is declared when repair costs exceed 70% of the vehicle's market value on the date of loss (calculated using alternative parts prices and PLN 65/h in the Kosztorys variant, PLN 110/h in Sieć Partnerska, or original-parts/ASO rate in ASO variant). Theft of the entire vehicle is also treated as total loss. Compensation equals the vehicle market value on the date of loss, not exceeding the sum insured, reduced by the value of salvage remains. After total loss payment, ownership of the vehicle must be transferred to ERGO Hestia.

Partial damage

Covered

Partial damage (szkoda częściowa) is covered under AC Maxi (AC Uszkodzenie i Kradzież), which is the key distinguishing feature compared to AC Mini (which covers only total loss above the 70% threshold). Settlement is by the cost-estimate method (Kosztorys: PLN 65/h, alternative parts) or service method (Sieć Partnerska: max PLN 110/h, alternative parts; ASO: authorised-dealer rate, original parts). ERGO Hestia assesses the scope of damage and determines indemnity accordingly. Pre-existing damage to parts being replaced reduces the payout proportionally.

Theft and robbery

Covered

Theft of the vehicle (including destruction or damage directly related to theft) is covered. At the time of theft the vehicle must have been secured as required by its construction; keys, opening/starting devices and vehicle documents must have been secured outside the vehicle. These exclusions do not apply if the vehicle was stolen by robbery (rabunek) or if the non-compliance had no causal link to the loss. Theft of vehicle parts resulting in partial damage is also covered under AC Maxi (but not AC Mini). Coverage excludes misappropriation (przywłaszczenie) by a third party. Compensation for total theft equals vehicle market value on date of loss (up to sum insured), net of salvage; ownership must be transferred to ERGO Hestia.

Glass damage (windscreen, rear and side windows)

Optional

Separate optional Ubezpieczenie Szyb cover with a sum insured of PLN 5,000 and a PLN 50 excess applicable to windscreen replacement. Covers the front, rear and side windows of the insured vehicle against: collision, sudden contact with persons/animals/objects, vandalism, sports equipment collision, fire/explosion/flooding/forces of nature, sudden external thermal or chemical action. Repairs use alternative parts; original parts used only if alternatives unavailable. Territorial scope: Europe. Excludes panoramic roofs, sunroofs, mirror glass, reflectors, anti-intrusion and tinting films, decorative trims, and windows with pre-existing unrepaired damage.

Natural perils

Covered

Included within the AC Maxi base perils: fire, explosion, flooding (zatopienie), hurricane, hail, lightning strike, avalanche, flood, earthquake and ground subsidence not caused by human activity; and sudden thermal or chemical action from outside the vehicle. These perils are listed in §4 of the OWU as causes covered by AC Uszkodzenie i Kradzież across all settlement variants. Note: submersion of liquid into the running engine (zassanie cieczy przez pracujący silnik) is explicitly excluded.

Vandalism

Covered

Intentional destruction or damage of the insured vehicle by third parties (wandalizm as defined in the OWU glossary) is covered under all settlement variants of AC Maxi (AC Uszkodzenie i Kradzież). It is explicitly listed as a covered cause of loss in the coverage table at §4. Vandalism damage must be reported to the police (§21 obliges the policyholder to notify police of any event that may have resulted from a crime or offence).

Replacement vehicle

Optional

A replacement vehicle is provided only under the Assistance po Wypadku i Awarii za Granicą variant, for up to 5 days after an accident or theft. The replacement vehicle segment corresponds to the insured vehicle (segment A/B → segment B; segment C → segment C; above segment D → segment D). Costs for fuel, insurance and the rental deposit/excess are at the policyholder's expense. A credit card or other security may be required by the rental company. Not available in the basic (Assistance po Wypadku) or domestic (Assistance po Wypadku i Awarii w Polsce) variants.

Driver and passenger accident insurance (NNW)

Separate optional NNW cover for the driver only (NNW Kierowcy) or driver and passengers (NNW Kierowcy i Pasażerów). Sum insured options: PLN 10,000 or 20,000 per person for driver-only; PLN 10,000, 15,000, 20,000 or 25,000 per person for driver and passengers. Benefits include: death (100% of sum insured), permanent health impairment (per schedule in Annex 1), temporary incapacity (1‰ of sum insured per day from day 10, or from day 1 if incapacity ≥30 days, max 180 days), medical costs (up to 30% of sum insured, excluding rehabilitation and transport costs), and dental reconstruction (up to 20% of sum insured, max PLN 2,000, max PLN 200 per tooth). Territorial scope: worldwide. Excludes accidents unrelated to vehicle use and pre-existing illness.

Key conditions

Driver age and experience limit

The You Can Drive product is exclusively available to natural persons (individuals) and sole traders (jednoosobowa działalność gospodarcza) who are under 30 years of age. Persons aged 30 or over are not eligible for coverage. There is no explicit minimum age or minimum driving-licence duration stated in the OWU, but the product is targeted at young drivers.

Repair network requirements

Three settlement variants are available: (1) Kosztorys – cost-estimate method; ERGO Hestia prepares the valuation; alternative parts prices apply; labour rate PLN 65 gross/h; repair can be performed at any workshop chosen by the policyholder. (2) Sieć Partnerska – service method; repair preferably at a Partner Network workshop or any workshop chosen by the policyholder; alternative parts prices; max PLN 110 gross/h labour rate. (3) ASO – service method; repair preferably at an Authorised Service Centre (ASO) or any workshop chosen by the policyholder; original manufacturer parts; labour rate based on local ASO average. Where alternative parts are unavailable, original parts are used (with depreciation deducted in Kosztorys). The policyholder must obtain ERGO Hestia's consent before commencing repairs; this requirement does not apply if ERGO Hestia waived inspection or failed to inspect within 7 days of loss notification.

Territorial scope

AC Maxi (AC Uszkodzenie i Kradzież): Europe, Algeria, Morocco, Tunisia, Israel and Iran. For losses arising in Belarus, Moldova, Russia or Ukraine a mandatory excess of PLN 1,000 applies (this does not apply to losses from vehicle collisions or sudden contact with persons, animals or objects). Losses arising abroad require the policyholder not to alter the vehicle or commence repairs without ERGO Hestia's consent, except for repairs necessary to continue safe travel not exceeding EUR 1,500 gross; costs above EUR 1,500 require prior approval. Reimbursement is at PLN equivalent using NBP Table A exchange rate on the date costs were incurred.

Anti-theft requirements

At the time of theft, the vehicle must have been secured in the manner provided for by its construction. Keys or devices used to open and start the vehicle, and vehicle documents, must have been secured outside the vehicle against access by unauthorised persons. These requirements are waived if their non-fulfilment has no adequate causal link to the loss, or if the vehicle was stolen by robbery (rabunek). Vehicles without a valid technical inspection (przegląd techniczny) are not covered if the technical condition contributed to the loss.

Claim notification deadline

The policyholder must notify ERGO Hestia of a loss immediately (niezwłocznie) after it occurs or upon becoming aware of it. Notification can be made by phone (58 555 50 50), through the Polisa Online account portal (polisaonline.ergohestia.pl), via the ergohestia.pl online form, in person or in writing through an ERGO Hestia representative, or in writing to the registered office. In the event of intentional or grossly negligent failure to notify promptly, ERGO Hestia may reduce the indemnity or benefit to the extent that the failure contributed to an increase in loss or prevented investigation of circumstances and effects of the event. The policyholder must also promptly report to police any event that may constitute a crime or offence (including vandalism).

Deductible rules

A standard deductible (udział własny) expressed as a percentage of the loss value may be selected at policy inception: 5%, 10%, 15% or 20% for non-theft losses, and separately for theft losses. For losses arising in Belarus, Moldova, Russia or Ukraine a mandatory PLN 1,000 deductible applies (does not apply to collision and contact perils). For glass damage (Ubezpieczenie Szyb) there is a fixed PLN 50 excess on windscreen replacement only. No deductible applies to tyre insurance (Ubezpieczenie Opon). Minimum claimable damage under AC is PLN 500 gross (regardless of settlement variant). If repair costs exceed the cost-estimate value, the policyholder must submit full invoices for labour, parts and materials.
