Direct payment

InterRisk pays compensation directly to the injured third party (or their estate/heirs) within 30 days of receiving notification of the loss; if circumstances cannot be clarified within that period, within 14 days from the date such clarification was possible, but no later than 90 days from notification (unless liability depends on ongoing criminal or civil proceedings). The undisputed portion of compensation is always paid within the standard 30-day period.

Poland – nationwide

Primary coverage: territory of Poland. By operation of law, also covers events in countries whose national bureaux are signatories to the Multilateral Agreement (Green Card system), at least to the minimum required by the law of the country of the event.

Third-party bodily injury liability

Covered

Minimum statutory guarantee sum per event, regardless of the number of injured parties: 6,450,000 EUR for bodily injury (death, personal injury, health impairment). Effective 6 November 2024 following implementation of EU Directive 2021/2118. Sum is calculated at the NBP average EUR/PLN rate on the date of loss. Covers all persons liable for the vehicle's movement, including the driver.

Third-party property damage liability

Legal defence costs (within guarantee sum)

Within the limits of the guarantee sum, InterRisk is obliged to reimburse the policyholder for necessary defence costs in criminal proceedings and costs of legal representation in civil proceedings, taken on the instruction of or with the consent of InterRisk (Art. 15 para. 2 of the Compulsory Insurance Act). This is a statutory obligation included in every MTPL policy; it is separate from the voluntary Ochrona Prawna add-on product.

Green Card (international motor insurance certificate)

Covered

An international motor insurance certificate (Green Card) is issued with the OC policy at no additional premium. It confirms valid MTPL coverage in countries whose national bureaux are signatories to the Multilateral Agreement. Concluding an OC policy automatically triggers the issue of a Zielona Karta for the same vehicle at no extra charge (OWU Pakiet Auto+ §9.8).

Roadside assistance – AutoAssistance Start (included with OC)

Covered

Concluding an OC policy automatically triggers a free AutoAssistance Start policy for the same vehicle (OWU Pakiet Auto+ §9.6). The Start variant covers: on-site vehicle repair following a road accident, towing to the nearest workshop or the insured's home address, assistance with a third party's vehicle immobilised due to the insured's fault (if the insured also holds InterRisk OC for that vehicle), and travel/administrative information. Valid within Poland only. No additional premium is required. Higher-tier assistance variants (Standard, Premium) are available as paid optional add-ons.

Driver personal accident (NNW – optional add-on)

Optional

Coverage for personal accident consequences (death, permanent disability, medical expenses) for the driver is not included in the base MTPL policy. It is available as the optional NNW (następstwa nieszczęśliwych wypadków) add-on under Pakiet Auto+, with a sum insured selectable from 10,000 PLN to 100,000 PLN per person. Note: third-party bodily injury to other road users is fully covered under the mandatory bodily_injury_liability component.

Passenger personal accident (NNW – optional add-on)

Optional

Personal accident coverage for passengers in the insured vehicle is not included in the base MTPL policy. Passengers injured through the fault of a third party are covered under the mandatory bodily_injury_liability. For cover of accidents caused by the vehicle's own driver, the optional NNW add-on (sum insured 10,000–100,000 PLN per person) must be purchased separately under Pakiet Auto+.

Key conditions

Territorial scope

The MTPL policy covers events occurring on the territory of Poland. By force of law it also covers, on a reciprocal basis, events on the territory of countries whose national bureaux are signatories to the Multilateral Agreement (Green Card System), providing at least the scope of protection required by the law of the country in which the event occurred or by Polish law, whichever is broader (Art. 25 of the Compulsory Insurance Act). The Green Card certificate confirms this international coverage and is issued without additional premium.

Green card rules

A Green Card (international motor insurance certificate) is automatically issued with every OC policy at no additional cost (OWU §9.8). It is valid in countries whose national bureaux are signatories to the Multilateral Agreement. The minimum insurance period for a standalone Zielona Karta is 15 days. The Zielona Karta coverage terminates when the underlying OC policy expires.

Driver restrictions

No driver-specific restrictions apply – MTPL covers civil liability of every person who drives the insured vehicle during the period of insurance cover (Art. 35 of the Compulsory Insurance Act). The insurer may pursue a recourse claim against a driver who caused damage intentionally, while under the influence of alcohol or narcotic substances, without a valid driving licence, or who fled the scene (Art. 43 of the Act).

Claim notification deadline

The insured person must notify InterRisk (via InterRisk Kontakt) promptly after the event. Under the Compulsory Insurance Act, the insurer must pay compensation within 30 days of receiving notification of the loss. Where circumstances cannot be clarified within that period, payment must be made within 14 days of clarification, but no later than 90 days from the original notification, unless liability depends on pending criminal or civil proceedings (Art. 14 of the Act).

Bonus-malus rules

There is no statutory bonus-malus system for MTPL in Poland. Each insurer sets its own premium based on factors including the vehicle type, the policyholder's claims history (accessible via the UFG Information Centre), place of vehicle registration, age of driver, and engine capacity. InterRisk applies its own internal rating factors. The premium history/claims record can be requested from the Ubezpieczeniowy Fundusz Gwarancyjny (UFG) information centre.

Mandatory coverage requirement

Coverage for third-party liability arising from vehicle movement, governed by the Act on Compulsory Insurance. The scope of coverage is standardized by law and identical across all insurers in Poland.

Automatic renewal

Unless the policyholder gives notice of termination at least one day before the end of the 12-month period, the policy automatically renews for another 12 months.

Policy period

Compulsory motor liability insurance is concluded for a period of 12 months, as mandated by Polish law.
