Legal Defence (standalone MTPL)

Legal assistance abroad ("Ochrona prawna za granicą") with a lawyer's fee limit of 2,000 EUR and a refundable loan of 2,000 EUR is available only within the optional Assistance Maksymalny variant under Chapter VII of the OWUK, and is therefore not a core MTPL benefit.

Green Card (International Motor Insurance Certificate – ZK)

Optional

Optional civil liability insurance (Chapter VI of OWUK) covering third-party liability arising from the use of the insured vehicle registered in Poland outside Polish borders, in the territories of countries signatory to the Multilateral Agreement as listed in the Green Card. The applicable guarantee sum equals the guarantee sum in force in the country where the incident occurred, but shall not be lower than the OC guarantee sum indicated in the policy. The contract is concluded for a minimum of 15 days and a maximum of 12 months and terminates simultaneously with the termination of the Polish MTPL contract. Coverage begins and ends upon the vehicle crossing the relevant state borders.

Roadside Assistance (Assistance – Podstawowy/Ekonomiczny/Rozszerzony/Maksymalny/Opony/Samochód zastępczy)

Assistance Podstawowy (Basic) is included by default in the OC package at no extra charge, covering on-site repair (up to 300 PLN, accidents only) and towing up to 75 km after an accident. Limits per tier: Podstawowy – on-site repair 300 PLN (accident only), towing 75 km (accident only); Ekonomiczny – on-site repair 300 PLN (accident+breakdown), towing 100 km, replacement car class B up to 2 days, tyre help 300 PLN or towing 120 km, transport of persons; Rozszerzony – on-site repair 600 PLN, towing 300 km, replacement car class B up to 4 days, tyre help, vehicle unlocking 300 PLN, fuel assistance, overnight accommodation 2 days, parking 4 days; Maksymalny – on-site repair 600 PLN/500 EUR (Poland/EU), towing 500 km, replacement car class C up to 7 days, all Rozszerzony benefits plus hospitalization cover 1,200 EUR, repatriation, vehicle recovery after repair, legal protection abroad 2,000 EUR. Driver Accident Insurance (NNW)

Optional

Optional personal accident insurance for the driver and passengers under Chapter V of the OWUK. Covers bodily injury (assessed per the NNW injury table in Chapter XIII) and death resulting from an accident arising from vehicle movement, occupancy of the vehicle at a stop, boarding/alighting, or roadside repair. The sum insured is chosen by the policyholder at inception and confirmed in the policy. Benefits: injury benefit as a percentage of the sum insured per the injury table; death benefit equal to the full sum insured if death occurs within 2 years of the accident. Does not cover pain and suffering, material losses, or lost profit claims.

Passenger Accident Insurance (NNW)

Optional

Passenger accident cover is included within the same optional NNW product (Chapter V of OWUK) that covers the driver. The NNW insurance covers consequences of accidents for both the driver and passengers of the insured vehicle. Exclusions include: no seatbelt worn during travel, exceeding the registered number of seats, no helmet during motorcycle/moped travel (where causally linked). Passengers travelling with an intoxicated driver are also excluded where a causal link exists.

Key conditions

Territorial scope

The MTPL (OC) insurance is mandatory on the territory of Poland. With the optional Green Card (ZK) add-on, civil liability coverage also applies on the territories of countries signatory to the Multilateral Agreement as listed in the International Motor Insurance Certificate, beginning and ending upon the vehicle crossing the relevant state border. The OC contract must be concluded no later than the date of vehicle registration and maintained continuously for the entire period the vehicle is registered in Poland.

Green card rules

The Green Card (ZK) is an optional voluntary extension under Chapter VI of the OWUK. It covers civil liability of the insured for damages caused to third parties by the movement of the vehicle (registered in Poland) in countries signatory to the Multilateral Agreement. The guarantee sum is the higher of: (a) the guarantee sum in force in the country of the incident, or (b) the OC guarantee sum in the policy. The Green Card contract terminates simultaneously with the Polish MTPL contract. The driver must carry and present insurance documents outside Poland upon request of control authorities.

Driver restrictions

The insurer has the right to seek recourse from the driver/policyholder if the driver: (1) caused damage intentionally or while intoxicated (alcohol, drugs, psychotropic substances); (2) obtained the vehicle by committing a crime; (3) did not hold the required driving licence; (4) fled the scene; (5) used the Green Card after termination of the insurance contract. The voluntary products (AC, NNW, Assistance) include general exclusions for drivers without a valid driving licence and for driving under the influence of alcohol or intoxicants.

Claim notification deadline

For the MTPL (OC) product specifically governed by statute, claim notification follows the requirements of the Act of 22 May 2003. Under the voluntary OWUK products bundled with OC: accident/fire notification – promptly, no later than 7 days from the event; theft notification – no later than 2 days from the day the policyholder became aware; assistance events – no later than 48 hours from the event. Failure to notify in time with wilful intent or gross negligence may result in a reduction of the indemnity if the breach contributed to increasing the loss or prevented determination of the circumstances.

Bonus-malus rules

Premium calculation takes into account the claims history for both MTPL (OC) and optional casco (AC) insurance, including the number of claims reported. An optional "Discount Protection Clause" (Klauzula ochrony zniżek) is available for the OC and/or AC contract for an additional premium: if one OC claim occurs during the policy period, it will not affect the premium for the next OC period; if one OC or one AC claim occurs on a combined OC+AC policy with this clause, it will not affect the next period's premium for the respective product. Second and subsequent claims are still taken into account. The clause's validity period equals the policy period.

Per mubi.pl sourced information, baggage and child seat insurance (sum insured 5,000 PLN) is included in the OC package price at Pevno. This cover is governed by Chapter IV of the OWUK and applies to the territory of Poland and other European countries (excluding Russia, Belarus, Ukraine, Moldova for theft). Cover includes damage to baggage/child seats following an accident, theft with the vehicle, theft from the vehicle, and theft from a locked external luggage carrier (roof box, etc.) if broken into.
