Key conditions

Territorial scope

Compulsory MTPL coverage applies primarily on Polish territory. Under the Green Card system, coverage extends to all countries whose national bureaux are signatories to the Multilateral Guarantee Agreement. Claims arising outside Poland are settled in accordance with the law of the country of the event, and may involve different guarantee sums and claim scope.

Green card rules

The Green Card certificate confirms civil liability coverage in Green Card signatory states. If a collision occurs outside Poland in a non-EEA country that is a Green Card system member and the at-fault vehicle is not registered in the country of the incident, the claim must be reported to the National Bureau of the country of the incident or directly to the at-fault party's insurer.

Driver restrictions

The MTPL policy covers any authorized driver of the insured vehicle. However, exclusions apply if the driver at the time of the incident: was under the influence of alcohol (above 0.5‰ blood alcohol) or narcotics and was authorized to use the vehicle; fled the scene of the accident; or did not hold a valid driving licence required under Polish law – unless these circumstances had no causal link to the damage.

Claim notification deadline

The insured is obliged to notify ERGO Hestia of the loss without undue delay after it occurs or after becoming aware of it. Notification can be made by phone (58 555 50 50), via the online account at polisaonline.ergohestia.pl, via the form on ergohestia.pl, or in writing. Intentional or grossly negligent failure to notify promptly may result in a proportional reduction of the claim, but only if the delay contributed to increased damage or prevented investigation of the event.

Bonus-malus rules

You Can Drive applies a bonus-malus system based on the insured's claims history. The premium level depends on the number of claims in the insurance history: more claims result in a higher premium. Profiling is used for premium calculation both at inception and at automatic renewal. No surcharge is applied for young driver age alone.
