Direct payment

The insurer pays indemnifications directly to injured third parties or their heirs within the coverage limits. In claims handled under direct indemnification agreements between insurers, the offer or motivated response is made on behalf of the counterpart insurer. Minimum payment within 40 days of claim declaration; full payment within 5 days of final expert assessment.

Mandatory Third-Party Bodily Injury Liability

Coverage for bodily injury and death caused to third parties as a result of traffic accidents involving the insured vehicle. Maximum indemnification of 70,000,000 EUR per claim, regardless of the number of victims, as established by Spanish regulation. The insurer is exempt if injuries resulted solely from the victim's fault or negligence or from force majeure unrelated to vehicle operation. Vehicle defects do not constitute force majeure.

Mandatory Third-Party Property Damage Liability

Coverage for property damage caused to third parties as a result of traffic accidents involving the insured vehicle. Maximum indemnification of 15,000,000 EUR per claim as established by Spanish regulation. Driver Accident Coverage (Highly Protected Driver)

Optional coverage (Modalidad Séptima) providing indemnification for death or permanent injuries (sequelae) suffered by the insured driver who is at fault in the accident. Compensation calculated per the traffic accident compensation tables (Baremo, Tables I, II, III, IV and VI of Royal Legislative Decree 8/2004). Maximum benefit: 1,500,000 EUR for death or permanent injuries. Benefit is proportional to the driver's degree of fault as determined by firm court ruling or accident report. Excludes temporary disability, post-traumatic cervical syndrome, and pain syndromes without objectifiable physical deficit.

Passenger/Occupant Accident Coverage

Optional coverage (Modalidad Quinta) for personal injury caused to vehicle occupants (excluding the driver) by a violent, sudden, external and involuntary cause while travelling in, boarding or alighting from the insured vehicle, or while performing roadside repairs. Coverage includes death, permanent disability (with detailed baremo scale), and medical assistance up to 1 year. Capital amounts are specified in the Particular Conditions. For occupants under 14 years of age, death benefit is limited to funeral expenses up to 600 EUR. Mandatory Passenger Insurance (Modalidad Sexta) applies to public transport vehicles with 9+ seats.

Territorial scope

Mandatory RC (Primera A) is valid in the European Economic Area and in all countries party to the Inter-Bureaux Convention (Green Card Convention), per Article 4 of Royal Legislative Decree 8/2004 and Article 6 of Royal Decree 1507/2008. Voluntary coverages (Primera B, Segunda, Tercera, Cuarta, Quinta, Séptima, Novena) are valid in Spain, all EU member states, Inter-Bureaux signatory countries listed on the International Insurance Certificate, and Andorra, Gibraltar, Liechtenstein, Monaco, San Marino, and Vatican City. Agrarian RC (Primera C) and driving licence suspension subsidy (Octava) apply only in Spanish territory. Substitute vehicle (Décima) applies in Spain, Europe including Russia up to the Urals, and non-European Mediterranean countries.

Green card rules

The Green Card (International Insurance Certificate) is issued by Caser for travel in Inter-Bureaux Convention countries. Mandatory RC coverage automatically extends to EEA countries and all Green Card signatory countries. For voluntary coverages, the specific countries covered are listed on the International Insurance Certificate. The insured must contact the local Green Card bureau in the country of the accident for claims abroad.

Driver restrictions

The vehicle is considered to be driven solely by the person or persons named in the Particular Conditions, whose declared characteristics form the basis for premium calculation. Coverage requires the driver to hold a valid driving licence. Driving under the influence of alcohol (exceeding legal limits), drugs or psychotropic substances constitutes a general exclusion and gives rise to the insurer's right of recourse. Driving without a valid licence also constitutes a general exclusion (except for theft cover). The insurer may exercise the right of recourse against the driver if the cause of the accident involves alcohol, drugs, intentional conduct, or other causes provided by law.

Claim notification deadline

The policyholder, insured, or beneficiary must notify the insurer of the occurrence of a claim within a maximum of 7 days of becoming aware of it, unless the policy stipulates a longer period. For liability (RC) claims, any judicial, extrajudicial or administrative notification must be communicated to the insurer within 24 hours. The insurer must be notified of theft immediately after filing a police report. Non-compliance may result in liability for damages caused by the failure to notify, unless the insurer becomes aware of the claim by other means.

Bonus-malus rules

Successive premiums are calculated based on the insured's personal claims history. For the first policy year, the observation period for calculating the new premium covers the first 10 months of policy validity. For the second and subsequent years, the observation period is 12 months, calculated from the end of the previous year's observation period. The claims history may result in premium increases or decreases at each renewal.
