Direct payment

The insurer manages legal defence and pays indemnities directly to injured third parties up to policy limits. For roadside assistance and replacement vehicle services, the insurer organises and pays service providers directly upon prior telephonic request; services not pre-authorised by the insurer are not reimbursed. For personal accident capital, payment is made to designated beneficiaries or legal heirs within five days of receiving required documentation.

Geographic scope

Spain (nationwide)

Mandatory third-party liability covers the full European Economic Area, states adhering to the Multilateral Guarantee Convention, and Green Card Inter-Bureaux countries. Voluntary liability and most other guarantees (own damage, fire, theft, legal defence, personal accidents) also apply throughout the EEA and Multilateral Guarantee Convention states, including Morocco. Roadside assistance covers vehicles in Spain, Europe and non-European Mediterranean coastal states within a 200 km coastal strip. Legal defence for administrative traffic infringements is limited to Spain. Replacement vehicle service is managed in Spain regardless of where the accident occurred.

Mandatory Third-Party Bodily Injury Liability

Covered

Covers bodily injury and death caused to third parties (excluding the insured driver) arising from the use and circulation of the insured vehicle, up to the legally established limit of 70 million EUR per accident regardless of the number of victims, in accordance with Real Decreto Legislativo 8/2004 and applicable European directives. Indemnities are calculated using the baremo established in the Annex to the Act. The insurer also assumes legal defence costs against civil liability claims, bail bond deposits and court costs.

Mandatory Third-Party Property Damage Liability

Covered

Covers property damage caused to third parties (excluding the policyholder, insured, owner, driver, their spouses and relatives up to the third degree of consanguinity or affinity) arising from the use and circulation of the insured vehicle, up to the legally established limit of 15 million EUR per accident regardless of the number of vehicles or assets affected. Additionally, Voluntary Third-Party Liability (Modalidad B) extends this coverage up to a maximum of 50 million EUR per accident for amounts exceeding the mandatory limit, and also covers liability for fire caused by a stationary insured vehicle (up to 600,000 EUR per accident) and liability for towing trailers/caravans weighing up to 750 kg with coincident registration plate.

Legal Defence and Damage Claim

Covered

Included as a core guarantee. Covers criminal defence in traffic-related criminal proceedings, including attorney and court fees. When the insured exercises the right to freely choose their own lawyer and solicitor, costs are capped at 3,005 EUR (VAT included) per claim under Poliza L11 / 3,000 EUR under the Generali ON AUTOS conditions. The insurer also advances bail bonds of up to 35,000 EUR per claim (Generali ON AUTOS) in criminal proceedings to secure the insured's provisional freedom. Damage claim coverage (Modalidad B) guarantees friendly or judicial claims against liable third parties for bodily and material damages suffered by the insured; it includes advance indemnity of up to 7,000 EUR for material damage where the counterparty insurer has confirmed payment in writing or a final court judgment exists, and third-party insolvency cover up to 12,000 EUR per claim for final unenforceable judgments. Administrative traffic fine defence is also included (Spain only) with unlimited written objections and appeals in the administrative channel.

Green Card / International Insurance Certificate

Covered

Mandatory third-party liability coverage operates automatically throughout the EEA and states adhering to the Multilateral Guarantee Convention. For territories outside these (non-EEA Green Card countries), the Green Card international certificate is required and issued upon request. When a claim occurs in an EEA member state, Spanish mandatory limits apply if they are higher than the limits of the state where the accident occurred.

Available as an optional add-on. Covers vehicles weighing under 3,500 kg. Territorial scope: vehicle assistance in Spain, Europe and non-European Mediterranean coastal countries within a 200 km coastal strip, from km 0. Personal assistance worldwide from km 0 (except overseas medical expenses, which apply abroad only). Covered causes of immobilisation: breakdown, accident, flat tyre, misfuelling, fuel running out, keys locked inside vehicle, and glass breakage preventing normal driving. Key service limits: mechanical assistance / towing up to 240.40 EUR per tow, with alternative tow to workshop up to 100 km from incident; vehicle rescue up to 600 EUR; vehicle storage up to 15 days / 160 EUR; hotel expenses up to 4 nights / 61 EUR per person per night (3-star Spain, 4-star abroad); occupant transfer or rental car up to 300 EUR; overseas medical expenses up to 6,000 EUR; overseas legal defence up to 1,250 EUR; interpreter fees up to 1,200 EUR; advance bail bonds abroad up to 6,100 EUR; advance funds abroad up to 1,500 EUR.

Driver Personal Accident Coverage

Optional

Available as an optional add-on (Accidentes Corporales Conductor y Ocupantes). Covers the driver and, depending on the specific conditions contracted, also all occupants. Benefits: (1) death benefit – 100% of insured capital, with an immediate advance of up to 3,000 EUR; (2) total permanent disability – 100% of insured capital (loss of two feet, two arms, two hands, one arm and one leg, one hand and one foot, complete paralysis, total blindness or complete and incurable mental alienation); (3) partial permanent disability – indemnity per baremo expressed as a percentage of insured capital, capped at 100% of capital for invalidez; (4) medical, pharmaceutical and hospitalisation expenses from accidents – in Spain, treated at insurer-designated clinics at no sub-limit; at freely chosen clinics or abroad, up to the sum insured as stated in special conditions (hospitalisation capped at 200 EUR/day); prostheses up to 700 EUR per claim; orthopaedic items up to 1,000 EUR per insured. Death and permanent disability payments cannot be accumulated for the same accident. Coverage period for declaring disability or death: within two years from the accident date (Generali ON AUTOS conditions).

Passenger Personal Accident Coverage

Available as an optional add-on (Accidentes Corporales Conductor y Ocupantes). Covers all occupants transported free of charge in the insured vehicle. The same benefits and baremo apply as for the driver: death, total or partial permanent disability, and medical/surgical/pharmaceutical/hospitalisation expenses from traffic accidents. Death and disability capitals are as stated in the particular conditions. Cannot accumulate death and total permanent disability benefits for the same accident. Policies may limit this guarantee exclusively to accidents suffered by the driver.

Claim Notification Period
