For travel assistance, the insurer coordinates and pays service providers directly; no reimbursement of services arranged outside the insurer's network. For legal defence, the insurer designates or accepts the insured's chosen lawyer and pays fees up to the policy limits. Indemnity for own-damage claims is paid within 40 days of loss declaration; minimum undisputed amount is advanced within the same period. Coverage limits

Bodily injury liability (mandatory civil liability)

Covered

Mandatory civil liability cover for bodily injury or death caused to third parties in traffic accidents involving the insured vehicle. The limit of 120,000,000 EUR per accident covers all victims regardless of their number, in accordance with current Spanish legal minimums. Injuries or death of the insured vehicle's own driver are excluded under mandatory cover (but may be covered under Art. 7 personal accident). Indemnities calculated per the Annex of Royal Legislative Decree 8/2004.

Property damage liability (mandatory civil liability)

Covered

Mandatory civil liability cover for property damage caused to third parties. The limit is 15,000,000 EUR per accident per current Spanish legal minimums. Damages to the insured vehicle itself, goods it transports, or property of the policyholder/driver/owner and their relatives up to third degree are excluded. Voluntary supplement (Modalidad B) extends cover beyond mandatory limits up to the amount agreed in the particular conditions, and additionally covers: third-party fire liability from parked vehicle (60,000 EUR limit) and trailer/caravan liability (≤750 kg, same registration).

Legal defence, penal defence and damage claims

Covered

Covers costs of penal defence, court bonds and damage claims arising from traffic accidents (Art. 10). The insurer assumes the direction of criminal defence (lawyer and court agent designated by the insurer at no cost to the insured). Where the insured exercises free choice of lawyer/court agent, the insurer covers fees up to a maximum of 1,500 EUR per claim. Penal bail bonds up to 35,000 EUR per claim. Damage claims (amicable or judicial) against liable third parties covered up to 1,500 EUR (free-choice limit). Insolvency cover for material damage claims up to 12,000 EUR. Advance of damage indemnity (minimum 300 EUR, maximum 7,000 EUR). Excluded when vehicle driven by persons under 25 years or with less than 2 years' licence experience unless expressly designated in particular conditions.

International certificate of insurance (Green Card)

Conditional

Coverage within the EEA and Multilateral Guarantee Convention states (including Morocco) is automatic under the policy. For territories outside those listed in Article 11(1), the Green Card (international certificate of insurance) must be issued. Coverage in those other territories is conditional on prior issuance of the Green Card by the insurer and is applied at the limits and conditions mandatory under the law of the state where the accident occurs.

Driver personal accident (death and permanent disability)

Covered

Covers the driver for death and permanent disability resulting from a traffic accident during the policy period (Art. 7). Capital for death or total permanent disability: between 30,000 EUR and 100,000 EUR (exact amount per particular conditions). In case of death, an advance up to 3,000 EUR is available to beneficiaries immediately. Permanent partial disability is indemnified by applying percentage scales per the policy baremo to the agreed capital. Medical assistance expenses (hospitalisation, pharmaceuticals, prostheses, dental prostheses, urgent care) are covered at 100% if treated by insurer-designated clinics in Spain; if treated abroad or by freely chosen doctors/clinics in Spain, coverage is limited to the sum insured in particular conditions, with a maximum of 6,000 EUR for expenses incurred abroad. All expenses covered for up to one year from the date of accident. Excluded: accidents caused by intentional acts, drug/alcohol influence, or when vehicle driven by unlicensed driver or person under 25/less than 2 years' experience (unless designated in particular conditions).

Passenger personal accident

Conditional

Article 7 covers personal accidents for both the driver and occupants of the insured vehicle. However, the particular conditions may restrict this guarantee exclusively to the driver. The scope (driver-only or driver plus occupants) is determined by what is expressly contracted in the particular conditions. When extended to occupants, the same death/disability capital and medical expense limits apply as for the driver cover.

Mandatory and voluntary civil liability, own damage, fire, theft, legal defence, damage claims and driver personal accident apply across the full EEA and states adhering to the Multilateral Guarantee Convention, plus Morocco (Art. 11). Within the EEA, if the accident occurs in another member state, Spanish mandatory limits apply if higher than the local mandatory limits. For territories outside Art. 11(1), a Green Card must be issued. Vehicle roadside assistance covers Spain, Europe and Mediterranean-rim countries from km 0; personal travel assistance is worldwide from km 0 (medical costs only abroad). Replacement vehicle is limited to Spain only (Art. 9).

Coverage in countries outside the EEA and Multilateral Guarantee Convention states requires prior issuance of the corresponding Green Card (Carta Verde) by the insurer. In non-EEA countries where the Green Card applies, coverage is at the limits and conditions mandatorily prescribed by the law of that state. The insurer will issue the Green Card upon request before travel to covered non-EEA territories.

driver_restrictions

Several coverages (voluntary civil liability, own damage, glass breakage, driver personal accident, legal defence, travel assistance) are excluded when the vehicle is driven by a person under 25 years of age or with less than 2 years' driving experience, unless that person is expressly designated in the particular conditions. The replacement vehicle guarantee is not available to drivers under 23 years or with less than 2 years' licence seniority under any circumstances. Drivers must hold a valid licence appropriate for the insured vehicle; use by unlicensed drivers is excluded from all covers (insurer retains right of recourse).

claim_notification_deadline

The policyholder, insured or beneficiary must notify the insurer of a loss within a maximum of 7 days of becoming aware of it (Art. 22). For legal defence claims, the insured must notify within 7 days providing full details (names of parties, witnesses, circumstances). For travel assistance, the insured must contact the assistance centre by telephone immediately upon the event occurring; claims not pre-authorised by the insurer will not be reimbursed. The insurer must pay the minimum undisputed indemnity within 40 days of receiving the loss declaration; full payment is due at completion of investigations. The insurer is in default if it has not paid within 3 months of the loss or 40 days of the loss declaration.

bonus_malus_rules

The policy does not contain an explicit named bonus-malus table in the general conditions. However, Article 13(7) provides that the premium is reviewed annually based on actuarial studies taking into account risk aggravations or reductions, including claims history. Each at-fault claim or own-damage claim reduces the insured's current discount level (bonificación) by one level, as confirmed by the product landing page.
