Direct payment
MAPFRE handles third-party liability claims directly; the insurer assumes legal defence of the insured against third-party claimants and bears all defence costs. For supplementary liability, payment is due within 5 days of extrajudicial settlement or court enforcement order. The insurer may exercise right of recourse against the insured in cases of drunk/drugged driving, intentional acts, or driving without a valid licence.

Coverage limits
Mandatory Third-Party Bodily Injury Liability
Covered
Covers the civil liability of the driver for bodily injury (injuries, incapacity or death) caused to third parties arising from the circulation of the insured vehicle, up to the limits established by Spanish law at any given time (Real Decreto Legislativo 8/2004). Amounts are set by statute and indexed periodically; the sum insured for the mandatory cover is whatever the legislation prescribes at the time of the loss. Damages to persons are calculated according to the criteria in the Motor Liability and Insurance Act.
Mandatory Third-Party Property Damage Liability
Covered
Covers property damage caused by the insured vehicle to third parties when the driver is found civilly liable under Articles 1902 et seq. of the Civil Code, Articles 109 et seq. of the Criminal Code and the Motor Liability and Insurance Act, up to the limits of the mandatory insurance in force. Optional supplementary liability extends coverage up to 50,000,000 EUR per accident.
Legal Defence
Covered
MAPFRE assumes the legal defence of the insured against third-party claimants and bears the associated defence costs. This voluntary cover applies across the same territorial scope as the supplementary liability cover, unless a different scope is specified in the particular conditions.
Green Card (International Insurance Certificate)
Conditional
Extension of mandatory third-party liability cover to countries adhering to Section III of the General Regulations of the Council of National Bureaux (countries outside the EEA/Section II area, such as Morocco, Albania, Israel and others). Must be requested in advance from MAPFRE and involves payment of the applicable premium supplement. Without the Green Card, mandatory cover applies only within Section II countries (EU/EEA plus Andorra, Serbia, Switzerland, Great Britain and Bosnia-Herzegovina).
Travel / Roadside Assistance (Asistencia en Viaje)

Optional coverage (must appear in the Particular Conditions) providing comprehensive roadside and travel assistance from kilometre zero (i.e., from the insured's home address). Services include: on-site mechanical breakdown repair (labour and travel costs covered, spare parts at the insured's expense); tyre change; vehicle extraction up to EUR 310; towing and transfer of occupants; vehicle transport to the insured's home workshop; return to home or continuation of journey; overnight accommodation during repair (max 3 nights, EUR 50 per insured per night, only if >50 km from home); collection of repaired/recovered vehicle; vehicle deposit/storage up to EUR 95; spare-parts location and dispatch; interest-free emergency loan abroad up to EUR 460; fuel delivery; wrong-fuel towing; spare-key delivery; towing after lateral-window breakage; transport of injured persons. Driver Accident Insurance
Covered
Personal accident cover for the driver of the insured vehicle in the event of bodily injury, permanent disability or death arising from a road traffic accident. Complementary benefits include up to EUR 15,000 for home adaptation and EUR 2,000 for vehicle adaptation when permanent disability reaches 60% or more on the policy scale.
Passenger Accident Insurance
Excluded
Bodily injuries or death of the driver of the insured vehicle are explicitly excluded from the mandatory third-party liability coverage. Passengers who are third parties (not the owner, driver, policyholder or their relatives up to the third degree) are covered under the mandatory third-party liability section for injuries caused by the insured vehicle. There is no separate, named 'passenger accident' benefit analogous to the driver accident cover. Passenger occupants may benefit from travel assistance (transport sanitario) under the Asistencia en Viaje section in the event of a road traffic accident.

The Green Card (Carta Verde / certificado internacional de seguro) is required to extend mandatory liability cover to countries adhering to Section III of the Council of National Bureaux General Regulations. It must be requested from MAPFRE in advance, subject to payment of the applicable supplement. The list of Section III countries may change over time; updated information is available at www.mapfre.es. Without the Green Card, the policy provides mandatory cover only in Section II countries.

The driver must have the valid licence or permit legally required for the insured vehicle at the time of the loss. Any authorised driver with sufficient legal authorisation qualifies as a covered driver. The habitual driver and occasional driver(s) must be declared in the application or in the Particular Conditions, as their characteristics (age, licence seniority, claims history) are rating factors. Driving under the influence of alcohol (above the legal blood/breath limit) or drugs excludes coverage under voluntary sections, though the insurer cannot invoke this exclusion against injured third parties in the mandatory section and retains a right of recourse against the insured. Driving without a valid licence excludes voluntary coverage; for the mandatory section the insurer pays the third party but retains a right of recourse. Intentional acts by the insured are excluded from all voluntary covers (unless driven by a state of necessity).
claim_notification_deadline
The policyholder or insured must notify MAPFRE of any loss within a maximum of 7 days from the date they became aware of it, unless a longer period is specified in the Particular Conditions. Notification must be in writing (letter, email, SMS or fax). Failure to notify within this deadline entitles the insurer to claim damages caused by the lack of notification, unless it can be proved that the insurer had knowledge of the loss through other means. The insured must also provide all information about the circumstances and consequences of the loss; failure to do so in bad faith or gross negligence may result in loss of the right to indemnity. The insurer must initiate loss assessment within 3 days of receiving the declaration, and must pay at least the minimum undisputed amount within 40 days of receiving the loss declaration.
bonus_malus_rules
MAPFRE applies a personal claims history system: on tacit renewal, the successive premium is calculated by applying MAPFRE's actuarially-based tariff scales in force at that time, taking into account any coverage modifications, risk aggravation or reduction, and the insured's personal claims history recorded in preceding policy periods. If the premium for the new period is higher than the previous one, MAPFRE must notify the policyholder at least two months before contract expiry. There is no explicit 'bonus-malus' table published in the General Conditions; the adjustment is embedded in the renewal tariff calculation. MAPFRE also offers the CaReward telematics programme which rewards safe drivers with discounts.
