Total loss settlement

In case of total loss (vehicle destroyed, lost and not recovered within two months, or repair cost plus residual value exceeds replacement value), the insurer pays the replacement value (Wiederbeschaffungswert) minus the value of the damaged vehicle. If new-value cover is agreed, 100% of the proven purchase price is paid for a total loss within the first 12 months from first registration.

Partial damage repair costs

If no total loss occurred, the insurer pays the cost of restoration and necessary transport costs of spare parts, or (if the vehicle is sold in damaged condition) the anticipated repair costs up to the difference between replacement value and the value of the damaged vehicle. A new-for-old deduction applies to tyres, battery and paintwork up to year 3, except this deduction does not apply for passenger cars, station wagons and trucks up to 1.5 tonnes payload.

Towing and recovery costs (limited)

Driver age and experience limit

No specific minimum driver age or experience threshold is stated in KB20. The vehicle may not be operated without a valid driving licence, under the influence of alcohol/drugs or other impairment, with unroadworthy tyres, or outside the mandatory winter-tyre period (1 November to 15 April); breach of these duties can result in the insurer being released from its obligation to pay.

Repair network requirements

The policyholder must obtain the insurer's approval before starting repairs or disposing of the damaged vehicle, and must give the insurer the opportunity to inspect it. Compensation for repair is only paid if the vehicle was properly repaired; there is no entitlement to a cash repair settlement in lieu of repair (no 'Reparatur-Ablöse'). Windscreen/window replacement with a new part is only paid after inspection by the insurer's own expert.

Territorial scope

Cover extends to Europe in the geographical sense, and in any case to the territory of states that signed the Multilateral Agreement between the national insurance bureaus of the EEA member states and other associated states (30 May 2002). Cover during sea transport is not interrupted if loading points lie within the territorial scope; it ends when loading is complete if the destination lies outside that scope.

Anti-theft requirements

The vehicle (and any special equipment/accessories) must be locked and secured in order for items kept in or attached to it to be covered; no specific immobiliser or alarm system is mandated in KB20.

Claim notification deadline

The policyholder must notify the insurer of the claim, with as precise a description of the facts as possible, within one week at the latest. Theft, robbery, collision with an unknown vehicle, unauthorized use by outsiders, fire, explosion, wildlife collision or malicious acts by outsiders must additionally be reported immediately to the nearest police station.

Deductible rules

A deductible (Selbstbeteiligung) applies per vehicle and per claim in the amount stated in the policy. For used vehicles, the deductible doubles if the required pre-existing-damage inspection is not submitted to the insurer within 6 working days of application; it remains at the agreed level if submitted in time. No deductible is charged on the recovery-cost benefit (Art. 5.5), and any deductible is waived when glass is repaired rather than replaced.
