Direct payment

Except where a third-party payment arrangement applies with an approved glass supplier, claims (e.g. glass breakage) are reimbursed to the policyholder based on an invoice in their name, marked as paid by the supplier.

Belgium (nationwide)

Belgium and, per the insurance certificate, every EU member state, Andorra, Monaco, Iceland, Liechtenstein, Norway, Switzerland, Serbia, Morocco, Tunisia, Turkey and the United Kingdom.

Unique selling points

There is no indemnity limit for bodily injury caused to third parties by the insured vehicle; ACM also pays interest, legal costs and lawyers'/experts' fees for civil actions even beyond the indemnity limits.

Legal defence (Protection juridique rider)

Optional rider covering penal defence and civil recourse up to 25,000 EUR per claim; contractual recourse (e.g. repair disputes) is capped at 5,000 EUR; insolvency of a third party is covered up to 6,500 EUR after a 250 EUR deductible. Separately, the compulsory liability guarantee itself pays legal costs and lawyers'/experts' fees for civil claims even beyond its own indemnity ceilings.

Roadside assistance (Mini/Maxi Assistance)

Mini Assistance is part of the compulsory liability guarantee and included in the premium: breakdown/towing service after an accident (reimbursed up to 200 EUR if self-organised, 400 EUR if imposed by the authorities), a category-B replacement vehicle for up to 5 days if the vehicle is immobilised over 4 hours, and repatriation of the vehicle and passengers if immobilised abroad more than 3 days, capped at the Eurotax value. Maxi Assistance is an optional paid upgrade adding cover for panne/fire/theft/vandalism, extending the replacement vehicle to 10 days (30 days after theft), and adding personal and Home Assistance services, valid up to 90 consecutive days abroad.

Driver accident protection (Protection du conducteur rider)

Optional rider covering the driver's bodily injury or death resulting from a traffic accident, carjacking, or loading/unloading of the insured vehicle, up to 1,250,000 EUR per claim. In case of death, forfeited moral-damage amounts apply: 15,000 EUR for a spouse/cohabiting partner, 15,000 EUR per first-degree relative, 7,500 EUR per second-degree relative. A BOB driver remains covered under these provisions even if this rider was not subscribed.

Passenger / vulnerable road user bodily injury compensation

Passengers of the insured vehicle are explicitly listed among the covered vulnerable road users (alongside pedestrians and cyclists). Under articles 29bis and 29ter of the law of 21 November 1989, bodily injury to vulnerable road users and to innocent victims of an accident involving two or more vehicles is compensated on a no-fault basis by the liability insurer(s), and bodily-injury compensation under the liability guarantee is unlimited.

Key conditions

Territorial scope

Cover applies to claims on public roads or public/private land in Belgium and in any country listed on the insurance certificate: all EU member states, Andorra, Monaco, Iceland, Liechtenstein, Norway, Switzerland, Serbia, Morocco, Tunisia, Turkey and the United Kingdom.

Green card rules

The insurance certificate (attestation d'assurance) lists the countries where cover is valid. When a claim occurs abroad, the compulsory motor-liability legislation of that country applies, but this can never reduce the broader protection granted under Belgian law.

Driver restrictions

The policyholder must have their habitual residence in Belgium, have reached the legal minimum driving age, and hold a valid driving licence issued or recognised under Belgian law matching the insured vehicle's category; the vehicle must be duly registered, roadworthy and hold a valid technical-inspection certificate. Non-compliance may lead to refusal of cover or nullity of the contract.

Claim notification deadline

The general conditions require any claim to be reported in writing within 8 days of becoming aware of it, while the IPID states 8 working days; theft must also be reported to the police (described as within 24 hours in the theft-guarantee definitions, though the general obligations article requires prompt notice), and any summons or judicial/extrajudicial document must be forwarded within 48 hours of service.

Bonus-malus rules

The bonus-malus scale runs from degree -3 to 22 with corresponding premium percentages (e.g. 51% at -3, 100% at the base degree 11, up to 230% at 22). New policyholders start at degree 11, reduced by 1 degree per year of licence held (down to -3) if 12 continuous months of prior EU insurance can be proven; each at-fault claim in the reference period adds 5 degrees; each claim-free insured year automatically reduces the degree by 1. A 'Joker' is earned once degree -3 is reached with 5 years claim-free: the next at-fault claim does not raise the degree, and a new Joker is earned after a further 3 consecutive claim-free years at -3.
