Direct payment

For third-party liability (BA) claims, Argenta pays the injured third party directly; the policyholder does not have to advance the compensation. For own-vehicle repairs carried out under the optional Omnium cover at an Argenta-approved repairer, a third-party-payer system applies so the policyholder does not have to pay the repair invoice upfront.

Coverage applies in Belgium and in every country for which the international insurance certificate (green card) is valid at the time of the claim; a stay in another EEA member state during the contract is never treated as a risk change, though the contract ends automatically once the vehicle is registered abroad.

Legal defence (Rechtsbijstand safe)

Optional 'Rechtsbijstand safe' module covering legal/judicial and extrajudicial costs up to 40,000 EUR: criminal defence for traffic offences, civil recourse against non-contractual third parties, civil defence (up to 5,000 EUR) against the own liability insurer's recourse claim, administrative disputes (registration, road tax, technical inspection) and disputes arising from contracts relating to the insured vehicle. Independently of this optional module, the base BA cover itself already pays, even beyond the indemnity limits, the interest, legal costs and lawyer/expert fees relating to civil proceedings arising from a covered claim.

Green card / international insurance certificate

The BA cover is valid, and Argenta issues an international insurance certificate (green card) confirming it, for every country for which the certificate is valid; if a claim occurs abroad the cover follows the compulsory motor insurance law of that country, without ever reducing the wider protection Belgian law grants.

Immediate assistance after accident

Every Argenta auto policy automatically includes immediate roadside assistance after an accident: a 24/7 phone line, towing of the immobilised vehicle to a garage of choice, transport of the occupants, and a replacement vehicle for 24 hours (extended to the next business day over weekends/holidays), or for 5 days in case of theft if Omnium is held. Beyond 30 km outside Belgium (within the green-card countries), Argenta organises and pays for towing and transport of occupants to the nearest garage. An optional, more extensive 'Pechbijstand' module (Europ Assistance Belgium) can be added for further breakdown assistance.

Driver accident cover (Bestuurder+ / Conducteur+)

Optional cover paying the authorised driver (domiciled in Belgium) or their beneficiaries, regardless of fault, for bodily injury or death resulting from a traffic accident involving the insured vehicle, up to a total of 500,000 EUR per accident (interest included). The base BA policy explicitly excludes the driver's own bodily injury, which is why this module exists.

Passenger accident / liability cover

Passengers transported in the insured vehicle are covered as third parties under the base BA liability cover, which has no indemnity limit for bodily injury; the IPID explicitly confirms material and bodily damage to third parties, including occupants, is covered. Vulnerable road users and innocent victims of the accident also benefit from a separate statutory compensation duty (articles 29bis/29ter of the 21 November 1989 act).

Key conditions

Territorial scope

Cover applies to claims occurring in any country for which the international insurance certificate is valid, on public roads or on public/private land; if the accident occurs outside Belgium, the cover applied is that required by the compulsory motor insurance legislation of the country concerned, unless Belgian law grants broader protection, in which case the broader protection prevails.

Green card rules

Argenta issues an international insurance certificate (green card) proving cover in every country for which it is valid; a stay of the insured vehicle in another EEA member state during the contract term is never treated as a risk aggravation or reduction, but the contract ends automatically as soon as the vehicle becomes registered in a country other than Belgium.

Driver restrictions

The insurer has a right of recourse against the policyholder and/or the insured if, at the time of the claim, the insured vehicle was driven by a person who had not reached the legally required minimum age, did not hold a valid driving licence for that vehicle, breached specific restrictions stated on their licence, or was subject to an ongoing Belgian driving disqualification (even if the accident occurred abroad); no recourse applies if the situation results solely from failure to complete a purely administrative formality.

Claim notification deadline

Every claim must be reported in writing immediately and at the latest within 8 days of its occurrence; the insurer cannot invoke this deadline if the report was made as quickly as could reasonably be expected.

Bonus-malus rules

Premiums for cars/light vans (and similar) follow a personal bonus-malus scale of 23 degrees (0 to 22), where degree 14 corresponds to 100% of the base premium (ranging from 42.5% at degree 0 to 200% at degree 22). New policyholders enter at degree 14, or degree 11 if the vehicle is used only for limited private/commuting or specific professional purposes. Each claim-free observed insurance period moves the driver down one degree; each period with one or more at-fault claims moves the driver up four degrees per claim. The scale never goes below 0 or above 22, and a driver stuck above degree 5 after five consecutive claim-free periods is automatically reset to degree 5.

BA-specific exclusions

Excluded from indemnity under the BA cover itself: damage to the insured vehicle; goods carried for professional reward (except clothing/luggage of transported persons); damage caused solely by the transported goods or their handling; damage from officially authorised speed/regularity/skill races; damage covered under nuclear-liability legislation; and damage caused by persons who took control of the insured vehicle by theft, violence or receiving stolen goods.

EEA stay does not affect the BA risk

A stay of the insured vehicle in another European Economic Area member state during the contract term can never be treated as an aggravation or reduction of risk under the BA guarantee and cannot trigger a contract change; the contract ends automatically only once the vehicle is actually registered in a country other than Belgium.

3-month limitation for the assistance/travel riders

For the optional Pechbijstand and Reisverzekering riders (Part 2, underwritten by Europ Assistance Belgium) — not for the BA guarantee — cover only applies to events occurring before the end of the first three consecutive months of a stay abroad; events after that point are not covered by these riders.
