Direct payment

Generali Italia manages third-party liability claims directly. Where the direct indemnification procedure (Risarcimento diretto, Art. 149 CAP) applies, the policyholder's own insurer handles payment to the damaged party. Generali Italia pays the amounts due to third parties up to the agreed limits. Subrogation rights are exercised against the at-fault insured in the cases provided for by law and the contract.

Third-Party Bodily Injury Liability

Covered

Covers damages involuntarily caused to third parties by the circulation of the insured vehicle when used in conformity with its function as a means of transport. The statutory minimum limit for bodily injury is €6,450,000 per claim; the policyholder may choose higher limits against payment of a higher premium.

Covered

Covers damages involuntarily caused to third parties' property by the circulation of the insured vehicle. The statutory minimum limit for property damage is €1,300,000 per claim; higher limits may be contracted.

Legal Defence (Tutela Legale)

Optional

Optional coverage providing legal defence of the insured in relation to the ownership, leasing, driving and road use of the insured vehicle. Available in two alternative forms: Forma Base (limit €25,000 per claim) or Forma Gold (limit €40,000 or €100,000 per claim, policyholder's choice). An additional Tutela Legale Forma Aiuto Multe is available for traffic-fine proceedings, purchasable only if the Jeniot telematics device is installed.

International Insurance Certificate (Green Card)

Covered

The policy includes the international insurance certificate (ex Green Card) for all countries listed and not crossed out on the certificate. When circulating abroad, the R.C.A. guarantee operates according to the conditions and within the limits of the individual national legislations, subject to any greater guarantees provided by the policy.

Roadside Assistance (Assistenza)

Optional

Optional coverage providing assistance services in the event of breakdown, accident, fire, theft or other covered events. Available in three forms: Small, Medium and Large, each with different service levels and limits. Managed by Europ Assistance Italia S.p.A., available 24/7 at 800 880 880. Each single benefit may be provided up to 3 times per insurance year. For Medium and Large forms, personal assistance services are also available when driving short-term rental or car-sharing vehicles.

Driver Accident Coverage (Infortuni – Forma Guidatore)

Optional

Optional accident coverage indemnifying the driver of the insured vehicle against bodily injuries (accidental events due to fortuitous, violent and external causes producing objectively ascertainable physical lesions) sustained while driving or using the vehicle, performing operations necessary to resume travel, or getting in or out of the vehicle. The base guarantee always includes Permanent Disability (IP). Additional optional covers include Death, Temporary Disability, Daily Hospital Allowance and Convalescence, Medical Expenses Reimbursement, Mobility Extension and Electric Vehicle Extension.

Passenger Accident Coverage (Infortuni – Forma Trasportati / Completa)

Optional

Optional accident coverage that can be extended to passengers (Forma Trasportati) or to both driver and passengers (Forma Completa). The insured sum per person is calculated by dividing the total insured sum indicated in the policy by the number of approved seats (excluding the driver's seat for Forma Trasportati). The base guarantee always includes Permanent Disability (IP). The same optional extensions as the driver form are available.

territorial_scope

The insurance covers Italy, Vatican City, the Republic of San Marino and all EU member states, as well as any additional countries listed and not crossed out on the International Insurance Certificate (ex Green Card). When circulating abroad, the R.C.A. guarantee operates according to the conditions and within the limits of the individual national legislations, subject to any greater guarantees provided by the policy. If the contract linked to the Green Card is terminated or suspended, the policyholder must immediately destroy the Green Card.

The Green Card (Certificato internazionale di assicurazione) is issued together with the R.C.A. policy and is valid in the countries whose abbreviation is not crossed out on the document. In the event of voluntary suspension of the contract, the policyholder must not use or must destroy the Green Card. When the contract lapses or is suspended, the policyholder must immediately destroy the Green Card.

driver_restrictions

The policyholder may choose from among four driver type options: (1) Any driver (free driving); (2) Experienced driver (minimum age 26); (3) Identified exclusive driver; (4) Driving for two (two cohabiting drivers identified in the policy). If at the time of the claim the vehicle is driven by a person whose characteristics do not match those indicated in the policy, Generali Italia exercises the right of subrogation against the insured up to a maximum of €5,000 (not exercised if use by a non-authorised driver is due to necessity or if the driver is a repair/custody employee).

claim_notification_deadline

The claim must be reported within 3 days from when the event occurred or the insured became aware of it, using the Amicable Accident Statement (Modulo C.A.I.) supplied by Generali Italia. The report must be followed as soon as possible by any additional information, documents and any judicial acts relating to the claim. Failure to report, inaccuracy or delay gives Generali Italia the right of subrogation. For Tutela Legale, the claim must be reported promptly and in any case within the time useful for the insured's defence.

bonus_malus_rules

The policy is underwritten in the Bonus/Malus form, articulated in 33 merit classes with premium coefficients ranging from 0.500 (classes 1–4) to 3.000 (class 33). Merit class evolution is governed by three tables (cases a, b, c) depending on the completeness of the risk record and the number of penalising claims (i.e. claims paid with principal or equal liability) in the last 5 policy years plus the current year. The malus applies only if principal liability of the insured is established or when the sum of partial liabilities from multiple shared-responsibility claims over the last five years is at least 51%. The policyholder may avoid premium increases by reimbursing (within 6 months of contract expiry) the amounts paid for claims in the preceding observation period (Riscatto Sinistro). An observation period (1st period: from policy inception to 60 days before first full annual expiry; subsequent periods: 12 months each) is used to determine merit class evolution.
