Direct payment

For accidents between two identified motor vehicles regularly insured with companies adhering to the direct settlement system (CARD), ITAS Mutua compensates its own non-responsible policyholder directly on behalf of the responsible party's insurer (risarcimento diretto, art. 149 C.A.). Optionally, the policyholder can choose the 'Risarcimento in forma specifica' guarantee, which settles claims via direct repair at an ITAS-affiliated body shop within 30 km of the policyholder's residence, with a 5% premium discount; repairs at non-affiliated shops are reimbursed with a 10% deduction. Indemnity is paid within 15 non-holiday days from the settlement act.

Bodily injury liability

Covered

ITAS Mutua covers civil liability for compulsory motor insurance up to the single combined limit per claim agreed and stated in the individual policy schedule; this single limit covers both bodily injury and property damage to third parties, including transported persons regardless of the title of transport. If the agreed limit exceeds EUR 11,000,000, damages caused by circulation in airport areas are covered up to a maximum of EUR 11,000,000.

Legal defence (Tutela legale)

Legal protection is an optional section purchasable only together with the MTPL guarantee. 'Tutela legale base' covers judicial and extra-judicial assistance for accident-related claims and criminal defence, with the sum insured per claim indicated in the policy; contractual disputes over EUR 500 are covered up to EUR 10,000 per year, and expert/technical consultant costs for insured boats up to EUR 15,000 per year. The optional 'Tutela legale estesa' extends worldwide coverage and additional protections up to EUR 100,000 (also valid for the base guarantee). A free annual legal consultation via the ITAS App is included.

Green Card (international insurance certificate)

Covered

The policy is valid, without a monetary sub-limit, in Italy, Vatican City, San Marino, EU states, and other listed states, plus any other state whose international code on the Green Card certificate is not crossed out. ITAS Mutua issues the Green Card certificate on the policyholder's request; it is valid for the same period for which the premium or premium instalment has been paid.

Roadside assistance

Optional roadside assistance sections (Autovettura and Autocarro) provide towing, mobile workshop, vehicle recovery, replacement vehicle, hotel expenses, medical/sanitary repatriation, corpse repatriation, and legal/cash advances abroad, each benefit limited per claim/year (e.g. towing EUR 500-1,500, taxi EUR 50, medical repatriation up to EUR 15,000, replacement vehicle up to 30 days). Each benefit is available up to three times per insurance year.

Driver accident (Infortuni del conducente)

Optional section, purchasable only with the MTPL guarantee, covering death or permanent disability (over 4%) of the driver due to accidents connected with the vehicle's circulation, up to the sum insured stated in the policy, with an absolute franchise of 4% on partial permanent disability. Medical expense reimbursement up to EUR 500 per insurance year is included. Not provided for drivers over 80 years of age.

Passenger accident / third-party liability for transported persons

The base MTPL guarantee includes liability for bodily injury caused to transported persons, whatever the title of their transport, within the single combined limit per claim stated in the policy; this is not a separate accident sum but part of the RCA liability limit.

Territorial scope

Valid in Italy, Vatican City, San Marino, EU states, Liechtenstein, Andorra, Monaco, Serbia, Switzerland, Bosnia and Herzegovina, Montenegro, United Kingdom, and other states listed as adhering to the Green Card system whose international code is not crossed out on the certificate.

Green card rules

ITAS Mutua issues the Green Card (international insurance certificate) on the policyholder's request; it is valid for the same insurance period for which the premium or premium instalment has been paid, and the policyholder must destroy or not use the certificate and Green Card upon transfer, theft or termination of the vehicle.

Driver restrictions

No general driver restriction applies to the base MTPL cover. Optional clauses can restrict or reward specific drivers: 'Guida esperta' limits driving to persons aged 25+ (owner 26+) with a premium discount, applying a repayable recourse up to EUR 2,000 if a younger driver causes a claim; 'Patto per i giovani' applies a behavioural code and recourse up to EUR 500 for drivers aged 18-26.

Claim notification deadline

The policyholder or insured must notify ITAS Mutua or the agency of a claim within three days of becoming aware of it (art. 1913 of the Civil Code); failure to comply may result in total or partial loss of the right to indemnity (art. 1915 Civil Code).

Bonus-malus rules

Premium evolves according to a Bonus/Malus merit class system with 30 internal ITAS classes (19-48) linked to a national universal conversion class (Classe CU, 1-18) governed by IVASS Regulation 58/2026 under art. 134 of the Insurance Code, based on claims recorded during the observation period, with specific rules for new vehicles, the 'Bersani-Bonus Familiare' additional-vehicle benefit, vehicle transfers, inheritance, and leasing/rental situations. An optional 'Bonus protetto' clause can neutralise the malus effect of the first claim in the observation period.
