Direct payment

For damage claims not covered by the direct third-party settlement procedure, Reale Mutua settles by direct repair of the vehicle at an authorized/affiliated bodyshop (carrozzeria convenzionata) rather than by cash reimbursement to the policyholder; if the policyholder has the vehicle repaired at a non-affiliated bodyshop in a fully-recoverable claim, a €250 penalty applies.

By law (Codice delle Assicurazioni Private, art. 128, as updated from 11 June 2022), the statutory minimum RCA liability limit is €7,750,000 per claim, of which €6,450,000 is allocated to bodily injury to third parties. Reale Mutua's AutoMia policy applies these statutory minimum limits unless the policyholder purchases higher limits for an additional premium.

Legal defence (Tutela Legale)

Optional Tutela Legale section (sold as 'Tutela Legale Estesa' or 'Tutela Legale Base'), managed by ARAG SE, covering legal fees and court costs to defend the insured's interests in disputes connected to the use of the vehicle. The overall massimale is the one agreed in the policy; within Tutela Legale Estesa, a specific sub-limit of €100,000 per claim (with no annual aggregate limit) applies to claims for compensation of injuries exceeding 9% permanent disability in Italy, or any personal injury claim occurring elsewhere in Europe.

Green Card (Carta Verde)

Covered

The International Motor Insurance Certificate (Carta Verde) is issued by Reale Mutua on request and extends the mandatory RCA cover to non-EU states adhering to the Green Card System whose country code is not crossed out on the certificate. It is valid for the period stated on it, and it ceases to be valid if the underlying policy is suspended or ceases; using the document after that date is unlawful.

Driver personal accident (Infortuni del Conducente)

Optional section covering the driver of the insured vehicle for death, permanent disability, medical expense reimbursement and hospitalisation daily allowance resulting from accidents connected to the vehicle's circulation, regardless of the driver's fault. Sums insured for death/permanent disability are set per policy (variable). Fixed figures stated in the T&Cs: a lifetime annuity of €6,200/year (initial, revaluable) is added if permanent disability is assessed at ≥60%; a fixed €10,000 indemnity applies for HIV contagion from a necessary blood transfusion; a €110/night hospitalisation allowance (max 90 nights) applies when costs are borne by the NHS; a €50 deductible applies to medical-expense reimbursement; reconstructive/plastic surgery is reimbursed up to €5,200; ambulance/medical transport up to €520 (or €2,600 for air ambulance).

Passenger personal accident

Excluded

The optional 'Infortuni del Conducente' personal-accident section applies only to 'the driver of the vehicle indicated in the policy, when at the wheel'; there is no dedicated personal-accident benefit for other transported passengers. Injuries to transported third parties are instead addressed under the RCA liability cover via the 'risarcimento del terzo trasportato' procedure (art. 141 Codice delle Assicurazioni), not under a specific passenger-accident sum insured.

Territorial scope

Cover applies in Italy, Vatican City, San Marino, all other EU member states, and Andorra, Bosnia and Herzegovina, Iceland, Liechtenstein, Norway, Monaco, the United Kingdom, Serbia and Switzerland; for driving abroad, cover follows the mandatory-insurance rules of the state where the accident occurred, subject to any higher limits provided by the policy.

Green card rules

The Green Card also covers states adhering to the Green Card System whose country abbreviation is not crossed out on the certificate, which is issued by Reale Mutua on request and is valid for the period stated on it; it ceases to be valid if the underlying policy is suspended or cancelled, and using it after that date is unlawful.

Driver restrictions

Cover is not operative, and Reale Mutua may exercise a right of recovery (rivalsa) against the policyholder, in cases including: an unlicensed driver (with waivers/limits in specific cases such as an expired licence pending renewal); newly-licensed drivers (patente da meno di un anno) driving a vehicle exceeding the power-to-weight limit of art. 117 of the Codice della Strada (recovery capped at €2,500 in family-member cases); drink-driving under art. 186 (recovery capped at €2,500, raised to €5,000 above 1.5 g/l); driving under drugs under art. 187 (recovery capped at €5,000); non-compliant passenger transport; a vehicle that failed its mandatory roadworthiness inspection; participation in unauthorised races; and non-compliant use of driving-school or rental-with-driver vehicles.

Claim notification deadline

The claim must be reported using the blue 'Constatazione Amichevole di Incidente' (CAI) form and sent to the intermediary managing the policy or to Reale Mutua within 3 days of the accident or of the policyholder becoming aware of it; claims can also be reported to the 24/7 Sinistri Auto hotline (800 092 092).

Bonus-malus rules

AutoMia Reale Autovetture uses a 'Bonus/Malus 38 classi' merit-rating system for cars, with 38 contractual merit classes carrying premium coefficients from class 1 (best, ×0.471) to class 38 (worst, ×4.400); the class assigned at each annual renewal depends on claims 'observed' (paid, with principal or ≥51% cumulated pro-rata responsibility) during the observation period, per the evolutionary-rules table. Contractual classes correspond to the market-wide Classe Universale (CU) scale (1–18, per IVASS rules) via correspondence tables, allowing comparison across insurers. Under the Bersani law, the merit class can be transferred between family members' vehicles, including between different vehicle types, where they cohabit.
