Direct payment
AXA pays the indemnity due in principal, related interest, and costs of civil proceedings once all information on the loss has been received; amounts due are settled within 30 days of their determination. Deductibles always remain payable by the policyholder.

Third-Party Bodily Injury Liability
Covered
The company's guarantee is unlimited for bodily injury caused to third parties by the insured vehicle, in accordance with Luxembourg motor third-party liability legislation. Coverage is valid in all countries listed on the green card (insurance certificate) per the agreement of 30 May 2002.

The company's guarantee is in principle unlimited for property damage caused to third parties. However, it is capped at €2,500,000 per claim for damage caused by fire, jet of flames, explosion or natural environment pollution, and at €12,500,000 per claim for terrorism-related damage.

Following an accident involving the insured vehicle, the company covers legal proceedings costs and fees up to €10,000, including defence before criminal courts, and recourse actions against liable third parties for vehicle damage, bodily injury and material damage suffered by the insured. Free choice of lawyer applies with the company's prior written agreement.

The green card materialises the motor civil liability coverage by the company and is the sole document valid to specify the territorial scope of the insurance cover. The civil liability cover is valid in all countries whose national insurance bureaus are contractually linked to the Luxembourg Bureau under the agreement of 30 May 2002 between national bureaus of EEA member states and associated states.

Optional coverage protecting the driver against bodily injury, permanent disability and death resulting from an accident involving the insured vehicle, regardless of fault. Two variants available: 'Protection du Conducteur' (Section 11) compensates based on a fixed disability scale up to amounts specified in particular conditions; 'Sécurité du Conducteur' (Section 12) indemnifies based on common Luxembourg law rules. Both are available as optional add-ons. Civil liability does not cover the driver's own injuries.

Passengers transported in the insured vehicle are covered by the compulsory civil liability guarantee for bodily injury and property damage they suffer. In the event of an accident, the insured vehicle's civil liability covers passengers' assistance and hospitalisation costs. Passengers with authorised seats on the registration document are covered; pro-rata reduction applies if the number of passengers exceeds the number of insured seats.

green_card_rules
The green card is the sole document valid for specifying the territorial scope of the insurance cover. It materialises the civil liability coverage. The policyholder must immediately surrender the green card to the company in case of vehicle ownership transfer or voluntary suspension. In the event of a loss occurring abroad, the Luxembourg Bureau and the national bureau of the foreign country are authorised to receive notifications, investigate and settle claims on the insured's behalf.
driver_restrictions
All drivers expressly or tacitly authorised by the policyholder or vehicle owner are covered (authorised drivers). The additional driver is always considered an authorised driver. Damage caused when the driver does not hold a valid driving licence required by law is excluded (with specific exceptions for expired licences, EU licences, and Luxembourg licence in foreign country). Judicial prohibition, administrative withdrawal or suspension of licence is equivalent to absence of a valid licence. An additional franchise of €1,250 applies when an undeclared driver with less than 3 years' licence causes an accident.
claim_notification_deadline
The insured and/or policyholder must notify the company of any claim as soon as possible and at the latest within 8 days, except in cases of force majeure, in writing or verbally against receipt. All acts, letters, summonses and court documents received must be immediately forwarded to the company. Any claim notification beyond the deadline allows the company to reduce its benefit in proportion to the prejudice suffered.
bonus_malus_rules
A bonus-malus (BM) personalisation system applies to the civil liability premium for natural persons. New policyholders start at degree 11 (100% of base premium). Each claim-free observation period (12 months) results in one degree reduction (down to -3, 45% of base). Each at-fault claim results in +3 degrees (up to degree 22, 250% of base). After 4 consecutive claim-free years, the degree cannot exceed 11. The observation period is the 12 months preceding the first day of the month before the policy anniversary. Change of vehicle or insurer does not affect the BM degree; a 5-year claims history certificate from previous insurers must be provided. A separate BM scale applies to the Material Damage guarantee (section 10.6).
