Section E also covers any other adult in the policyholder's private car who is accidentally injured while travelling in or getting into/out of the vehicle, resulting in death, permanent total loss of sight in one or both eyes, or loss of any limb within three calendar months. Maximum benefit per injured person is €5,000; aggregate maximum per policy year is €10,000 across all persons and accidents. Only available on Comprehensive private car policies. Persons below age 18 or aged 76 or older are excluded. Territorial scope
The primary Geographical Area is Malta. Section C (third party liability) automatically extends to all Designated States (EEA member states, UK, Switzerland, Andorra, San Marino, Vatican City) and to Third Countries on direct transit between Malta and a Designated State where no Foreign Bureau exists. For Designated States, the cover guaranteed is at least the minimum required by the law of that state. Full policy cover (Sections A, B, D, E, F, etc.) for private cars and private motorcycles automatically extends to all Designated States for up to 30 consecutive aggregate days per policy year; beyond 30 days requires prior written agreement and additional premium (Endorsement AMP001). For other motor vehicles, prior notification and additional premium are required for any Designated State extension. Green Card extension to Third Countries requires prior notification and payment (Section G2, Endorsement AMP003). Judgments are only enforced from courts within Malta or a Designated State; awards from Third Country courts are not honoured.The policy covers use of the insured vehicle in Malta and Gozo. Third-party liability cover automatically extends to all EU member states, the UK, Switzerland, other EEA countries, Andorra, and Serbia at the minimum statutory level required by each country's law.Third party liability is covered while driving the insured vehicle in all Designated States (EU/EEA member states, Andorra, San Marino, Serbia, Vatican City and Switzerland) and through Third Countries on direct journeys between Malta and a Designated State. Green card rules
Within all Designated States (EEA countries, UK, Switzerland, Andorra, San Marino, Vatican City), a Green Card is not required; the Certificate of Motor Insurance serves as sufficient proof of compliance. For Third Countries (states outside Malta and outside Designated States), a Green Card must be obtained from Atlas before travel by notifying Atlas and paying an additional premium (Section G2, Endorsement AMP003). The Green Card extension applies only for the period and countries shown on the Green Card issued. Customs duties and general average charges incurred in covered countries due to an insured loss are also reimbursed.A Green Card (International Motor Insurance Certificate) is issued free of charge as proof of insurance for travel abroad. Maltese policies automatically provide the legal minimum third-party cover in EU/EEA countries, UK, Switzerland, Andorra, and Serbia. Policyholders must notify the insurer if they wish to extend Comprehensive or Fire and Theft cover for use abroad.All Designated States have agreed that a Green Card is not necessary for cross-border travel within those states; the Certificate of Motor Insurance is sufficient evidence of compliant cover. For travel to any country that is not a Designated State, the policyholder must notify Elmo prior to travel and, upon payment of any agreed additional premium to extend the underlying cover, Elmo will issue an International Motor Insurance Card (Green Card) free of charge for the period indicated.A Green Card is not required for travel within designated states; the certificate of motor insurance provides sufficient evidence of compulsory cover compliance. For travel to third countries (non-designated states), a Green Card must be requested at least two weeks before departure and an additional premium is payable. Driver restrictions
All drivers must be Authorised Drivers shown in the Schedule and/or Certificate. Drivers must hold a valid licence for the class of vehicle being driven (extended to 30 days past expiry pending renewal). Excluded drivers include: those disqualified from driving; those who have had insurance cancelled, declined, or special terms imposed; those with undisclosed criminal convictions; those banned from driving in any country; those with a medical condition or disability affecting their ability to drive (unless accepted in writing by Atlas); and those driving under the influence of alcohol or drugs. The policy covers driving by motor trade employees for maintenance/repair, hotel/restaurant/car-park employees parking the vehicle, and situations where the vehicle is stolen without the policyholder's permission.The vehicle must be driven with the policyholder's permission. The driver's traffic accident history for the past 4 years and any penalty points incurred must be disclosed on claim forms. Failure to disclose all material facts may invalidate a claim.Only Authorised Drivers as defined in the Policy Schedule (numbered 1–9) are covered. Cover is void if driven by: a person not listed as an Authorised Driver; a person disqualified from driving; a person who does not hold or has not held a valid driving licence for the relevant category; a person under the influence of alcohol beyond the legal limit set by Cap. 65 Laws of Malta; a person who tested positive for drugs. Specific age-based excess bands apply to drivers under 21 years, between 21 and 24, and those over 25 with less than 2 years driving experience.Authorised/permitted drivers are defined by the number code on the policy schedule: (1) policyholder only; (2) policyholder and spouse/partner; (3) policyholder and any person aged 25+; (4) policyholder and any person aged 21+; (5) policyholder and any person; (6) policyholder and any employee. All drivers must hold a valid driving licence for the vehicle category; licences expired more than 60 days before the accident, suspended, withdrawn or under disqualification are excluded. Age-related excesses apply for drivers under 25. For use abroad, authorised drivers are restricted to the policyholder and any other person named and accepted by the insurer. Policy does not cover use for hire or reward (except non-profit car-sharing).
Claim notification deadline
The policyholder must notify Atlas as soon as possible of any incident that may lead to a claim. In all cases, Atlas must be advised in writing within fourteen (14) days of an accident occurring, or Atlas may refuse to pay the claim (except as required under Legislation). The policyholder must complete a 'front to rear' form in duplicate in the event of a front-to-rear collision; co-operate with police in the event of theft or criminal acts; and immediately forward any unanswered legal documents (notices of prosecution, writs, summonses, etc.) to Atlas. Repairs to the motor vehicle must not be authorised in excess of €125 without Atlas's prior approval.Claims must be notified to Citadel in writing as soon as possible. Notification may be made at the Head Office in Floriana, at any branch, or via any insurance intermediary. Any legal or judicial notifications received must be forwarded immediately to Citadel without being answered.The policyholder must notify Elmo in writing as soon as possible after any occurrence which may result in a claim. Every judicial notification or communication relating to a claim must be sent to Elmo immediately. In the event of theft or criminal act, police must be advised immediately. No admission of liability must be made without Elmo's consent. Theft claims will not be settled prior to three months from the date of loss.Claims must be notified as soon as reasonably possible after any accident, injury, loss or damage. For motor legal expenses (Section 9), incidents must be reported within 90 days of discovery. For prosecution or legal proceedings, notification must be immediate and in writing. In the event of theft or criminal act, the police must be notified immediately.
Bonus malus rules
Atlas operates a No Claims Discount (NCD) scheme governed by its declared NCD Rules (separate insert forming part of the Policy). NCD is reduced at renewal following any at-fault claim. For comprehensive private car policies, NCD at the 6th year (65%) is automatically protected; optional NCD protection is available at a nominal additional charge for the 4th year (60%) and 5th year (65%) levels (Section H1). For third party fire and theft and comprehensive private car policies, one at-fault claim in a 2-year period does not forfeit NCD. NCD is totally forfeited at renewal if the cover is third party only (private cars and commercial vehicles), third party fire and theft (commercial vehicles), or comprehensive (motorcycles), and one or more at-fault claims occurred. Claims for windscreen/window damage and personal accident do not affect NCD on comprehensive private car policies. Claims for loss of keys, child seats, emergency expenses and legal assistance do not affect NCD on comprehensive and third party fire and theft private car policies. If an accident is not the policyholder's fault and expenses are recoverable, there is no NCD effect on any motor policy. If the third party is uninsured and the policyholder is not at fault, the excess is refunded and NCD is not affected (private cars).Citadel applies a No Claim Discount (NCD) to the premium based on the number of claim-free years. Malta does not operate a centralized statutory bonus-malus system; NCD is applied at the individual insurer's discretion. Citadel's NCD may be transferable between insurance companies, between spouses, between vehicles, and from an individual to a company where the individual holds 51% or more of the shares, subject to Citadel's acceptance.A No Claims Discount (NCD) is applied as a percentage reduction on the premium for claim-free years. For Private Cars – Comprehensive: 0% at inception, 25% after year 1, 35% after year 2, 40% after year 3, 65% after year 4 and year 5. For Third Party Only / Third Party Fire & Theft: 0% at inception, 20% after year 1, 30% after year 2, 40% after year 3, 60% after year 4, 65% after year 5. Claims reduce the NCD step as per the published scale. For Commercial Vehicles: max 40% NCD after 4+ consecutive claim-free years; a single claim triggers a step-back of two NCD steps.No Claim Discount (NCD) increases on each claim-free renewal per insurer's scale. A claim causes NCD reduction (step-back by two years for Comprehensive and Third Party Fire & Theft; full loss for Third Party Only unless driver has 65% NCD). Free protected NCD applies automatically from the 5th+ consecutive claims-free year for drivers aged 25 and over (Comprehensive and Third Party Fire & Theft only). Optional purchased NCD protection available from the 3rd year on the scale for drivers aged 25+ on Comprehensive and Third Party Fire & Theft at additional premium. Uninsured driver promise: if damaged by an uninsured, traceable driver who is not at fault, no NCD loss and excess refunded. Payments under personal accident (Section 3) and glass claims do not affect NCD.
Proof and next steps
Direct payment policy
Atlas pays third party liability claims directly to claimants as required by Maltese legislation (Motor Insurance Third Party Risks Ordinance Cap 104). For own-damage claims, Atlas pays repairers directly or settles with the policyholder. Finance/hire-purchase balances are paid directly to the finance company first, with any surplus paid to the policyholder.Claims payments are made directly to the policyholder's bank account via SEPA bank transfer. The policyholder must provide IBAN and BIC/SWIFT details on the claim form. Payments can only be made to bank accounts within the Single Euro Payments Area (SEPA).Claims must be lodged in writing at Elmo's Head Office, a branch, a TII office, or by email or post. Claims submitted by phone are not accepted. Elmo's cost control team orders and delivers parts to the approved repairer. For VAT-registered commercial vehicle owners, the owner purchases parts and claims settlement net of VAT once liability is determined.GasanMamo pays repairers directly for authorised repairs under comprehensive cover; for third-party bodily injury and property damage claims the insurer settles with claimants directly; third parties may contact the insurer directly as allowed by Maltese legislation.
