Direct payment

For WA liability claims the insurer settles directly with injured third parties and the policyholder may not admit liability or pay compensation without consent. Under the industry Directe Schadeafhandeling scheme, however, WA and WA Beperkt Casco claims are excluded from direct own-insurer settlement — the policyholder must claim from the at-fault party's insurer rather than AnsvarIdéa directly.

Coverage applies in the countries shown (and not crossed out) on the International Motor Insurance Certificate (Green Card) attached to the policy, generally covering Europe and neighbouring Mediterranean countries; cover ceases if the vehicle stays abroad for more than six consecutive months.

Legal defence costs

Covered

The costs of proceedings we choose to conduct and of legal assistance provided at our request are covered, if necessary above the sum insured; fines, settlement sums and criminal-process court costs are excluded. A separate optional Rechtsbijstand Motorrijtuig module (only if shown on the policy) additionally covers external legal-aid costs up to €15,000 per conflict.

Roadside assistance (WA level)

Covered

For vehicles under 3,500 kg train weight insured at least at WA level, assistance covers transport of the damaged vehicle and of the driver/passengers within the Netherlands after an accident, fire or other external calamity; a stoppage caused only by mechanical breakdown is not covered at WA level. Wider cross-border recovery and breakdown assistance apply once Mini Casco or Casco is also in force.

Driver accident/injury cover

Excluded

Liability for the driver's own personal injury (personenschade van de bestuurder) is explicitly excluded from the WA cover. Drivers who want accident protection must separately purchase the optional Ongevallenverzekering voor Inzittenden (OVI).

Passenger liability / accident cover

Covered

Passengers occupying a legally permitted seat are covered as third-party victims under the liability section (subject to the same liability limits) if they are injured due to the insured vehicle; cover does not apply to persons outside the driver's cabin or passenger seats. Separate optional Ongevallenverzekering (OVI) and Schadeverzekering voor Inzittenden (SVI) modules provide fixed accident/damage benefits regardless of fault.

Key conditions

Territorial scope

Cover applies to events occurring in the area shown on the Internationaal Verzekeringsbewijs (Green Card); any territory crossed out on the certificate is excluded. Cover ends if the vehicle stays abroad more than six consecutive months.

Green card rules

The policyholder receives an International Insurance Certificate (Green Card) that lists exactly which countries are covered; some non-WAM countries apply higher statutory liability limits, and those higher limits then apply automatically.

Driver restrictions

No cover if the driver had no valid licence for the vehicle, was disqualified from driving, drove under the influence of alcohol, drugs or medication affecting driving ability (unless the policyholder proves this was without their knowledge and against their will), used the vehicle without authorisation, for hire/reward, or in races, speed trials or on a circuit.

Claim notification deadline

The WA-specific terms do not state a fixed notification deadline; claims must be reported as soon as reasonably possible under the General Conditions. For the optional legal-aid (Rechtsbijstand) module, the event must in any case be reported within three years of becoming aware of it.

Bonus-malus rules

Premium is set via a 20-step bonus-malus scale; the discount rises to a maximum of 80% from step 15 upward after claim-free years, and falls by several steps after a claim (severity depends on the number of claims in the past year). Once a policyholder has more than 15 pure claim-free years, a single claim always causes the record to fall back to 10 pure claim-free years, since actuarial analysis shows years beyond 15 no longer reduce risk further.
