Territorial scope
The MTPL (OC) policy covers losses arising from the movement of the insured vehicle in Poland and other EU member states, as well as Andorra, Bosnia and Herzegovina, Montenegro, Iceland, Liechtenstein, Norway, Serbia, Switzerland, and the United Kingdom. For countries outside this list that participate in the international Green Card system, a Green Card certificate must be carried. Exclusions for Belarus, Moldova, Russia, and Ukraine apply to Autocasco but not to mandatory OC.Cover applies in Poland and all EU member states, plus Andorra, Iceland, Liechtenstein, Norway, Serbia, and Switzerland. The Green Card (Zielona Karta) is issued at no extra cost and extends proof of cover to non-multilateral Green Card member states (e.g. Morocco, Tunisia, Iran). The separate PZU Auto Zielona Karta (ZK) product covers civil liability in countries that are members of the Green Card system but are not signatories to the Multilateral Agreement and where the insured event is therefore not covered by the standard OC. Direct Claims Settlement (BLS) applies only to incidents occurring in Poland.The MTPL (OC) policy covers events occurring in the territory of Poland. On a reciprocity basis, it also covers events in the territories of countries whose national bureaux are signatories to the Multilateral Agreement. The Green Card extends coverage to these countries from the moment the vehicle crosses the relevant border.The policy covers events on the territory of the Republic of Poland and on the territory of states whose National Bureaux are signatories to the Multilateral Agreement (Green Card system). Border OC covers EEA countries and Switzerland. For damage abroad, Warta's liability is limited to the guarantee sum prescribed by the laws of that country, but not less than the Polish statutory minimum.
Green card rules
The Polish OC policy automatically serves as proof of liability insurance within the EU and in countries recognising the Polish compulsory OC. A separate Green Card certificate (Zielona Karta) is issued on request and confirms liability coverage in countries outside the EU that are signatories to the Multilateral Guarantee Agreement. The Green Card is available from ERGO Hestia and provides coverage equivalent to the OC policy. Carrying the Green Card is mandatory in certain non-EU countries.The Green Card (Międzynarodowa Karta Ubezpieczenia Samochodowego) is issued by PZU upon the policyholder's request as part of the OC policy at no additional premium (§ 55 OWU). A separate PZU Auto Zielona Karta (ZK) policy must be purchased for countries that are Green Card system members but not signatories to the Multilateral Agreement (i.e. countries where the insured event is not covered by standard OC). The ZK guarantee sum equals the OC guarantee sum for the same vehicle. ZK premium is included in the OC premium when both are concluded for the same vehicle (§ 55 OWU). A ZK policy requires a valid OC for the same vehicle (§ 66 para. 12 OWU) and has a minimum duration of 15 days.The Green Card (Ubezpieczenie Zielona Karta – ZK) is issued as part of the OC Package at no extra charge. The applicable guarantee sum is that of the country of the event, but not less than the Polish statutory minimum stated in the policy. The ZK policy term is a minimum of 15 days and maximum of 12 months. It terminates simultaneously with the Polish OC policy. The driver must carry the Green Card document abroad and present it upon request by control authorities. UNIQA is not liable for consequences of failure to present the document. The ZK policy is terminated simultaneously with the dissolution of the Polish OC contract.The standard MTPL policy issued by Warta serves as proof of insurance in all countries participating in the Green Card system (Multilateral Agreement signatories). For travel in EEA countries and Switzerland, border OC applies if the policyholder does not hold a valid domestic OC policy or Green Card. For damage caused in other signatory states, Warta is liable up to that state's minimum guarantee sum, at least matching the Polish statutory minimum.
Driver restrictions
Coverage is excluded for losses where the driver: (a) was under the influence of alcohol (≥0.5‰ BAC or ≥0.25 mg/l breath alcohol), narcotics, or similar substances and was authorised to use the vehicle, where this affected the occurrence or extent of loss; (b) left the accident scene and was authorised to use the vehicle, where this affected the increase in loss; (c) did not hold a required driving licence and was authorised to use the vehicle, where this affected the occurrence of loss. These exclusions apply only to the additional (voluntary) insurance elements bundled with OC (Wariant II/III), not to the mandatory OC liability cover itself.Any person authorised to drive the vehicle is covered under the OC. Excluded from cover (with right of recourse against the driver) are cases where the driver: caused damage intentionally or while under the influence of alcohol or drugs; obtained possession of the vehicle by committing a crime; did not have the required driving licence (except to save life or property or in pursuit of a criminal); or fled the scene of the accident. The OC covers third-party claims regardless of which authorised driver was behind the wheel.The OC policy covers any person driving the vehicle, including those authorised by the owner. Cover does not apply if the driver did not hold the required driving licence, or was driving under the influence of alcohol, narcotics, psychotropic substances, or similar substances. UNIQA has the right of recourse against the driver (not the policyholder) in such cases, as well as if the driver obtained the vehicle through a crime, fled the scene, or used a Green Card after policy termination.The statutory MTPL policy covers liability of the vehicle holder and any driver operating the vehicle. Warta has the right to seek recourse from the driver who caused damage if the driver: (1) intentionally caused the damage, was under the influence of alcohol, drugs or intoxicants; (2) obtained possession of the vehicle through a criminal act; (3) did not hold the required driving licence; (4) fled the scene of the accident.
Claim notification deadline
The insured must notify ERGO Hestia of the event immediately after it occurs or upon learning of it. Notification channels: iHestia online account (ihestia.ergohestia.pl), online form at www.ergohestia.pl, through an ERGO Hestia representative, or by phone at 801 107 107 or 58 555 5 555. In the event of wilful breach or gross negligence in notifying, ERGO Hestia may reduce compensation only if the breach contributed to increasing the loss or prevented ERGO Hestia from determining the circumstances and consequences of the event. Payment is due within 30 days of notification, or within 14 days of clarification of all necessary circumstances.For OC claims there is no specific contractual deadline for the injured third party to notify PZU; the statutory limitation period under art. 819 of the Civil Code is 3 years from the date the claimant learned of the damage and the party liable (extended to 20 years if the event resulted in personal injury or death). PZU must pay compensation within 30 days of receiving notification of the insured event; if clarification of circumstances is required, within 14 days of when those circumstances could reasonably have been clarified (§ 88 OWU). The policyholder/insured must promptly notify PZU of the event and provide all necessary information and documents.After an accident the policyholder/insured must: notify the police if there are casualties or circumstances suggesting a crime; provide necessary identification information to other parties; notify UNIQA of the event without undue delay; submit the documents and data required to establish liability. Under the ZK, the insured must also notify UNIQA if the claimant brings court proceedings. The IPID states that payment is made within 30 days of claim notification; if full investigation is impossible within 30 days, the undisputed part is paid within 30 days and the remainder within 14 days of when clarification became possible.Under the base MTPL policy, the insured must notify Warta promptly of any claim event and provide all necessary information. The insured must also inform Warta in writing within 14 days of any transfer of vehicle ownership. For the optional OC Szybka Wypłata add-on (C6331), the claim must be reported no later than 7 days after the incident via Warta's Customer Service Centre (COK).
Bonus malus rules
The premium is calculated based on the insured's claims history (bonus-malus system). An optional No-Claims Discount Protection add-on (Ubezpieczenie Ochrony Utraty Zniżki OC) is available in Wariant III: if one claim is made during the OC policy period, upon renewal of the subsequent OC policy with ERGO Hestia the insurance history of the insured vehicle is maintained at the previous (pre-claim) level, preserving the claims-free discount. If more than one claim occurs, only one claim is disregarded for the next renewal.PZU applies its own proprietary bonus-malus (BM) tariff table to determine the OC premium based on the policyholder's claim history. The insurer accesses the policyholder's loss history via the UFG (Motor Insurance Guarantee Fund) database in real time upon policy inception using the owner's PESEL/REGON number. Claim-free years reduce the premium; at-fault claims increase the next year's premium. PZU also honours no-claims history accumulated in other EU member states from 24 July 2025 pursuant to EU Implementing Regulation 2024/1855, provided the policyholder submits the standardised EU claims-history certificate. An optional paid add-on (protection of discounts / ochrona zniżek) allows the policyholder to protect earned discounts against the first at-fault loss within a policy year at an additional premium of approximately 20 PLN for OC.Premium is calculated based on the individual insurance history of the policyholder, including the number of claims under OC and AC policies over the preceding period. UNIQA offers up to 80% discount for long claim-free histories. An optional 'protection of discounts' clause (Klauzula ochrony zniżek) is available for an additional premium: under it, one OC claim per policy year does not affect the premium for the renewal period. The premium is determined at the time of application using the tariff in force, taking into account regional zone, vehicle classification, usage, payment method, and insurance history.Warta applies a bonus-malus system to MTPL pricing. The premium is adjusted based on the policyholder's claims history, which Warta retrieves directly from the Insurance Guarantee Fund (UFG) database for vehicles registered in Poland. Foreign claims history can be taken into account if the policyholder submits a 'Certificate of Insurance History' in the format prescribed by EU Implementing Regulation 2024/1855 of 3 July 2024. The specific bonus-malus scale and discount/surcharge percentages are determined individually at the time of policy issuance based on claims experience.

Direct payment policy
Direct claims settlement (BLS – Bezpośrednia Likwidacja Szkód) is available: if the insured vehicle is damaged by a third-party driver insured with a BLS-participating insurer, the claim can be reported directly to ERGO Hestia, which settles and then recovers from the at-fault insurer. Property-damage-only claims up to PLN 30,000, maximum two vehicles involved, no court proceedings, with confirmed fault documentation.PZU operates a Direct Claims Settlement system (BLS – Bezpośrednia Likwidacja Szkody). PZU OC policyholders who are not at fault in a collision may claim compensation directly from PZU (their own insurer) rather than from the at-fault driver's insurer. BLS applies to property-damage-only collisions in Poland involving exactly two vehicles where the at-fault party is identified and the repair cost does not exceed 30,000 PLN. PZU then settles with the at-fault insurer on the policyholder's behalf.UNIQA participates in the Direct Loss Settlement (BLS) system. Claims from qualifying incidents (damage in Poland, no injuries, only two vehicles involved, at-fault driver insured with a BLS participant, written statement obtained) may be handled directly by the victim's own insurer, without contacting the at-fault party's insurer.Warta participates in the BLS (Bezpośrednia Likwidacja Szkód – Direct Claims Settlement) system. Policyholders who are victims of accidents caused by drivers insured with other BLS-member insurers may report the claim directly to Warta instead of pursuing the at-fault driver's insurer. The optional add-on product 'OC Szybka Wypłata' (C6331) extends this capability with a PLN 500,000 per-event limit for vehicle damage claims.
