Key conditions
Territorial scope
Compulsory MTPL (OC) covers Poland. On a reciprocal basis, OC also applies in countries whose national bureaux are signatories of the Multilateral Agreement. The Green Card extends civil liability coverage to those countries outside Poland. AC Mini and AC Theft are limited to Poland; AC Damage and Theft / AC Elements cover Europe plus Algeria, Morocco, Tunisia, Israel and Iran (with a PLN 1,000 own contribution for losses in Belarus, Moldova, Russia and Ukraine, except for collision losses). NNW covers the whole world. Assistance covers Poland (basic tier) or Poland and Europe (extended tier). Glass covers Europe. Tyres cover Poland.
Green card rules
The Green Card (Ubezpieczenie Zielona Karta, §15–16 OWU) covers civil liability for damage caused by the vehicle outside Poland in countries whose national bureaux were signatories of the Multilateral Agreement on the date the insurance contract was concluded. Compensation is established and paid within the limits of civil liability as defined by the law applicable to the loss event. Compulsory OC (without the Green Card add-on) also applies on a reciprocal basis in Multilateral Agreement countries.
Driver restrictions
The insured vehicle is defined as a vehicle registered in Poland as a passenger car, cargo/passenger or off-road vehicle with payload up to 850 kg, and must not be subject to a leasing agreement. Coverage is excluded if: (a) the driver was under the influence of alcohol (BAC >0.5‰ or breath alcohol >0.25 mg/dm³) or drugs at the time of the incident and was authorised to use the vehicle, unless this had no causal link to the damage; (b) the driver left the scene of the accident and was authorised to use the vehicle, unless this had no causal link to the damage; (c) the driver did not hold the required driving licence at the time of the incident and was authorised to use the vehicle, unless this had no causal link to the damage (§17 OWU). Cover is also excluded for vehicles used for business purposes (except sole traders' vehicles), for racing/test driving, for vehicles with tampered safety-system memory, and during mandatory military or police requisition.
Claim notification deadline
The insured must notify ERGO Hestia of a loss immediately after it occurs or after becoming aware of it (§26 OWU). Notification can be made by phone (58 555 50 50), via the Polisa Online portal, via the website form, in writing to the registered office, or electronically. ERGO Hestia pays compensation within 30 days of receiving the claim notification, or within 14 days after the date on which circumstances necessary to determine liability could have been established with due diligence (with the undisputed portion paid within 30 days in any case). If the insured wilfully or through gross negligence fails to notify ERGO Hestia promptly and this contributed to an increase in the loss or prevented ERGO Hestia from establishing the circumstances of the event, ERGO Hestia may reduce the compensation accordingly.
Bonus-malus rules
The premium for the compulsory MTPL (OC) is calculated on the basis of risk profiling that takes into account the historical number of claims: the more claims in the insurance history, the higher the premium. For automatic OC renewal, the premium is recalculated based on data from the previous policy term, with the number of claims as the primary risk factor. Policyholders with many claim-free years benefit from significant discounts. The insurer uses data from the Central Vehicle Register (CEPiK) and other databases to verify the insurance history.
