Exclusions apply if the insured failed to follow safety rules, practised sports in unauthorised locations, or ignored pre-trip safety regulations.
COVID-19 treatment
Excluded
COVID-19 is not explicitly addressed in the OWU (OWU IT 68/2015, effective 31.12.2015). General exclusions in §4 ust.1 pkt 8 exclude epidemics or contaminations announced in mass media before the conclusion of the insurance contract. Therefore COVID-19 as a declared epidemic/pandemic would generally fall under this exclusion.
Pre-existing / chronic conditions
Optional
By default excluded: exacerbations of chronic conditions for which the insured was treated during the two years prior to contract conclusion are not covered (§4 ust.3 pkt 2). Coverage of chronic condition exacerbations can be added for an additional premium (§4 ust.3 intro). Chronic disease is defined as a diagnosed condition of long-term course lasting at least 6 months, continually or periodically treated. Sudden illness (nagłe zachorowanie) triggered by a new condition unrelated to prior disease is covered by default.
Winter sports coverage (amateur)
Optional
Amateur recreational skiing on marked runs (narciarstwo zjazdowe po oznaczonych trasach), cross-country skiing (narciarstwo biegowe), and snowboard on marked runs are included in the definition of amateur sports (§2 pkt 2, as amended by Annex 1 effective 11.08.2016). However, amateur sports in general require an additional premium per §4 ust.3 pkt 1. Off-piste skiing and snowboarding constitute extreme sports (§2 pkt 27d) and are excluded unless explicitly extended.
Extreme / adventure sports coverage
Excluded
Extreme sports are explicitly excluded under §4 ust.1 pkt 20 and §2 pkt 27. These include: rock/ice climbing, alpinism, Himalayism, speleology, bouldering, canyoning, trekking above 5,500 m a.s.l., mountain kayaking, rafting, hydrospeed, kitesurfing, diving below 15 m and freediving, ski jumps, ski alpinism, off-piste skiing/snowboarding, bungee jumping, parachuting, paragliding, motorised hang gliding, gliding, piloting aircraft/helicopters, extreme cycling/motorcycle/quad tracks, vehicle races/rallies, combat sports (MMA, UFC, K1, judo, karate, kick-boxing, Muay Thai, Krav Maga, Taekwondo), zorbing, and expeditions to polar zones, Alaska, Siberia, Kamchatka, northern Canada territories, and desert areas more than 20 km from the nearest city/settlement/road.
Pregnancy-related coverage
Conditional
Partially covered on specific conditions. Childbirth before the 32nd week of pregnancy and associated care for mother and child is covered up to the medical expenses insured sum (§5 ust.2 pkt 13). One medical visit per insurance period related to a sudden deterioration of health in connection with pregnancy (excluding childbirth itself) and related transport to a medical facility is covered up to the equivalent of 250 EUR (§5 ust.2 pkt 14). Childbirth from the 32nd week onwards and related care is excluded (§6 ust.1 pkt 2). Abortion is excluded unless to save the mother's life (§6 ust.1 pkt 3). Artificial fertilisation and infertility treatment are excluded (§6 ust.1 pkt 4).
Personal liability insurance (private life)
Optional
Optional extension available for an additional premium (§3 ust.2 pkt 3). Covers the insured's civil liability for personal injury or property damage caused to third parties during travel outside Poland and the country of permanent residence. The guarantee sum (suma gwarancyjna) is declared per policy. The liability limit for property damage is 20% of the guarantee sum (§16 ust.2). Also covers expert fees, court costs, and preventive action costs. Excludes: damage arising from business activity, professional liability, compulsory insurance systems, use of aircraft/watercraft (except rowing boats, kayaks, water bikes), contractual assumption of third-party liability, damage to close relatives, and damage to rented movable property.
Legal assistance costs
Covered
Covered within the Assistance module. If the insured comes into conflict with local law abroad and the charges relate exclusively to civil liability, Centrum Pomocy INTER Polska organises legal assistance and covers attorney fees up to 1,000 EUR. Not covered if the conflict arose from: conducting business or working abroad, driving or storing a motor vehicle, or committing or attempting to commit a crime. INTER Polska is not liable for the actions of the legal assistance provider.
24/7 assistance service
Covered
24/7 telephone duty at Centrum Pomocy INTER Polska is included for every insured who has concluded a medical expenses insurance contract (§5 ust.2 pkt 2 and §5 ust.3 pkt 1). Assistance services include: guarantee of payment of treatment costs, message relay to family/employer, travel companion costs (accommodation up to 100 EUR/day, max 7 days), post-hospitalisation accommodation (up to 200 EUR/day up to sum), travel continuation after hospitalisation, child care and return, close relative visit (if hospitalisation ≥10 days and life-threatening), replacement driver (up to 500 EUR), organisation of post-return treatment/rehabilitation and psychology consultations.
Key conditions
Assistance call deadline
The insured must contact Centrum Pomocy INTER Polska within 3 days of the event before taking any independent action (§23 ust.6 pkt 1). For assistance events, the contact must be made within 7 days (§23 ust.12 pkt 1). If contact is impossible, the insured should seek immediate medical care and follow physician instructions.
Unauthorized treatment
If the insured refuses transport back to Poland or the country of permanent residence that has been medically approved by the Assistance Centre doctor, coverage for medical expenses, accident consequences, and assistance ceases immediately from the moment of refusal (§6 ust.2). Non-compliance with Centrum Pomocy INTER Polska physicians' recommendations also allows INTER Polska to deny claims if this affected the occurrence of the insured event (§6 ust.1 pkt 15).
Purchase while abroad
A contract may be concluded for a third party already abroad, but not earlier than 5 days before the start of the insurance period (§21 ust.4). This 5-day restriction does not apply in the case of uninterrupted continuation of insurance with INTER Polska (§21 ust.5).
Chronic conditions
By default, exacerbations and complications of chronic conditions for which the insured was treated in the two years prior to contract conclusion are not covered (§4 ust.3 pkt 2). Chronic disease is defined as a diagnosed pre-contract condition of long-term course (at least 6 months), continually or periodically treated (§2 pkt 7). Coverage of chronic condition exacerbations may be added for an additional premium. An additional premium surcharge applies for chronic diseases at underwriting (§20 ust.5 pkt 3).
Pregnancy
One medical visit per insurance period due to sudden deterioration of health related to pregnancy (excluding childbirth itself) and related transport to a medical facility is covered up to the equivalent of 250 EUR (§5 ust.2 pkt 14). Childbirth before the 32nd week of pregnancy and associated care for mother and child is covered up to the medical expenses insured sum (§5 ust.2 pkt 13). Childbirth from the 32nd week onwards, abortion (unless to save the mother's life/health), artificial fertilisation and infertility treatment are excluded (§6 ust.1 pkt 2-4).
Pre-existing condition exclusions
Sudden illness (nagłe zachorowanie) is covered only if it arises suddenly and unexpectedly abroad, threatens life or health, and is NOT a consequence of a prior disease or condition (§2 pkt 16). Exacerbations of chronic conditions treated in the past two years are excluded by default but can be extended with an additional premium (§4 ust.3 pkt 2). STDs, AIDS, and HIV infection are explicitly excluded (§4 ust.1 pkt 22). Depression, mental illness, congenital defects are also excluded (§6 ust.1 pkt 5).
Coverage duration limit
Under the special protection system (system ochrony specjalnej), a single trip abroad may not exceed 45 days; the contract may only be concluded in individual form (§21 ust.7 pkt 2). Under the term protection system (system ochrony terminowej), cover may be granted for a maximum of 365 days (366 in a leap year), available in individual, group, or open form (§21 ust.7 pkt 1).
