Direct payment

Fidelidade substitutes the insured in the amicable or litigious settlement of any covered claim occurring during the policy period and is subject to direct action by injured third parties or their heirs, meaning the insurer deals directly with third-party claimants rather than reimbursing the policyholder.

Geographic scope

Portugal (mainland and the autonomous regions of Madeira and the Azores)

Covers accidents throughout the territories of countries whose national insurance bureaus have signed the Agreement between national insurance services, namely EU member states, other EEA countries (Iceland, Liechtenstein, Norway), the UK, Switzerland, Faroe Islands, Channel Islands, Gibraltar, Isle of Man, San Marino, Vatican City, Andorra and Serbia, plus other countries covered by a valid Green Card.

Unique selling points

  • Legal Protection can advance the cost of repairing accident damage caused by an identified, fully at-fault third-party driver, before the claim is recovered from that driver's insurer.
  • A 24-hour, every-day telephone assistance line supports policyholders at the moment of a claim and throughout any contracted travel-assistance service.
  • Legal Protection can advance bail and criminal-process cautions if the driver is detained abroad following a road accident.
  • The optional Vital Driver Protection cover calculates compensation using the official 'Proposta Razoável' formulas, covering future loss of income, biological damage, home/vehicle/workplace adaptation and lifetime care - well beyond the basic driver-accident minimums.
  • The optional Acquisition Value cover pays the original purchase price, rather than the depreciated market value, in case of total loss for vehicles up to three years old.

Coverage limits

Bodily injury liability (compulsory MTPL)

Covered

The insurer's liability is always limited to the maximum amount fixed in the Particular Conditions of the policy, whatever the number of persons injured by a claim, and corresponds at all times to at least the compulsory minimum capital set by Decree-Law 291/2007 of 21 August; this document does not itself state the exact euro figure of that legal minimum.

Property damage liability (compulsory MTPL)

Covered

The insurer's liability for material damage to third parties is limited to the amount fixed in the Particular Conditions, corresponding at all times to at least the compulsory minimum capital under Decree-Law 291/2007; the exact euro figure is not stated in this source.

Green Card / International Motor Insurance Certificate

Covered

For vehicles habitually garaged in Portugal, the international insurance certificate (Green Card), the provisional certificate, the payment notice, or the civil liability certificate constitute proof of the contract. The policy can further extend civil liability cover to the circulation of the vehicle in other States, provided cover is guaranteed by a valid Green Card for those countries. It is not a monetary capital but a proof-of-cover/territorial-extension mechanism.

Roadside Assistance (Assistência em Viagem)

€200 – €2,500

Optional Special Condition, sold in BASIC or PLUS modalities for vehicles up to 3,500 kg and BASE or MAIS for vehicles over 3,500 kg. Towing/roadside repair (desempanagem e/ou reboque) limits are €200 (BASIC) / €500 (PLUS) for vehicles ≤3,500 kg, and €1,000 (BASE) / €2,500 (MAIS) for vehicles >3,500 kg, plus vehicle-extraction limits of €75-€1,500 depending on tier and weight, generally within Europe and non-European Mediterranean-basin countries or Portugal only for some sub-benefits.

Driver Personal Accident (Proteção ao Condutor)

Optional

No limit stated

Optional Special Condition paying Death, Permanent Disability and Treatment-Expenses indemnities to the driver in case of a road accident; the specific capital amounts are fixed in the Particular Conditions of each policy and are not stated as fixed figures in this source. A more extensive alternative, 'Proteção Vital do Condutor', can be contracted instead, covering future loss of income, biological damage, home/vehicle/workplace adaptation and lifelong assistance calculated under the official 'Portaria da Proposta Razoável' rules; both also allow an optional 'Dívida Segura' add-on that pays outstanding vehicle-financing debt on death or permanent disability of grade 75+, ending at the renewal after the vehicle turns 8 years old or the insured turns 75.

Passenger Personal Accident (Ocupantes da Viatura)

Optional

No limit stated

Optional Special Condition paying Death, Permanent Disability and Treatment-Expenses indemnities to all persons carried free of charge in the insured vehicle, including the driver, in case of a road accident; the specific capital per insured person is fixed in the Particular Conditions and is not stated as a fixed figure in this source. If the vehicle's authorised seating limit is exceeded at the time of the accident, indemnities are reduced proportionally using a fixed formula.

Key conditions

Territorial scope

Cover applies to accidents occurring in the territories of all countries whose national insurance bureaus adhere to the Agreement between national insurance services (EU member states, EEA states Iceland/Liechtenstein/Norway, UK, Switzerland, Faroe Islands, Channel Islands, Gibraltar, Isle of Man, San Marino, Vatican, Andorra and Serbia), plus direct routes linking two EEA territories without a national insurance service, and can be extended to other countries where covered by a valid Green Card.

Green card rules

The Green Card (international insurance certificate) is one of the accepted proofs of the contract for vehicles habitually parked in Portugal, alongside the provisional certificate, payment notice, or civil liability certificate; for vehicles habitually parked outside the EEA, a valid frontier insurance certificate is additionally required. The Green Card can also be used to extend liability cover to other countries beyond the automatically-covered territory.

Driver restrictions

Third parties remain compensated under compulsory MTPL regardless of driver fault, but the insurer retains a right of recourse (direito de regresso) against the at-fault driver in specific cases: driving under the influence of alcohol above the legal limit or of drugs/toxic substances; driving without a valid licence for the vehicle category; theft/unauthorised use of the vehicle; deliberately causing the accident; abandoning the injured party; or breaches related to vehicle roadworthiness inspections that caused or aggravated the accident.

Claim notification deadline

The Policyholder or Insured must notify the insurer in writing of any covered claim as soon as possible, and never later than 8 days from the date of the occurrence or from the date they became aware of it, under penalty of being liable for resulting losses.

Bonus-malus rules

A no-claims bonus/malus system applies to the premiums of the Responsabilidade Civil cover (and, where contracted, several facultative covers). Entry classification depends on years insured, number of claims in the last 5 years and years without claims; evolution at each renewal follows a transition table based on the previous year's bonus/malus class and number of claims recorded in that annuity, ranging from a maximum bonus of -50%/-55% to a maximum malus of +130%.
