Direct payment

Cover under the policy is always conditional on prior payment of the premium. The insurer must notify the policyholder in writing of the amount due at least 30 days before each premium instalment falls due; non-payment of the initial premium (or its first instalment) automatically terminates the contract from inception, and non-payment of a renewal premium prevents the contract from renewing.

Key conditions

Territorial scope

The contract covers accidents occurring in Portugal and in all countries whose national insurers' bureaux have adhered to the Agreement between National Insurers' Bureaux, as well as on any direct route connecting two EEA territories lacking a national bureau.

Green card rules

Proof of insurance may include the Green Card (international motor insurance certificate) for circulation outside the EU/EEA in countries adhering to the Green Card multilateral agreement; coverage in such countries requires a valid Green Card and is subject to bilateral agreements where no national insurers' bureau exists on a given route.

Driver restrictions

Mandatory third-party liability cover continues to protect injured third parties even if the vehicle was driven by an unlicensed driver, by someone under the influence of alcohol or drugs, or in other prohibited circumstances; however, in these situations the insurer holds a statutory right of recourse (direito de regresso) against the responsible driver or policyholder after indemnifying the victim.

Claim notification deadline

The policyholder or insured must notify the insurer in writing of any claim as soon as possible and never later than 8 days from the date of the accident or from becoming aware of it, providing all relevant information and documentary or witness evidence; failure to do so may create liability for resulting losses.

Bonus-malus rules

Under the standard bonus/malus regime the premium is reduced by 5% for each consecutive claim-free year and increased by 20% for each claim in the same year (applied to the tariff premium net of any prior bonus/malus). After two consecutive claim-free years a special regime raises the bonus to 25% or removes an existing malus. The maximum bonus is 55% for the AUTLG/AUTRE light-vehicle products (50% for other products) and the maximum malus is 150%.
