Direct payment

The insurer pays compensation directly to injured third parties. In cases of compulsory civil liability, the insurer pays the injured party directly and may subsequently seek recourse against the policyholder or driver if exclusion grounds apply (e.g. drunk driving, intentional damage). For voluntary civil liability, payment is made to injured third parties within the agreed limits in the Condiciones Particulares.

Coverage limits

Bodily injury liability (compulsory + voluntary)

Mandatory coverage (Art. 23) covers bodily injury liability up to the legally regulated quantitative limits in force at the time of the accident (€70,000,000 per accident since 1 January 2008, updated annually by European CPI). Voluntary liability (Art. 25) extends coverage above the mandatory limit up to the amount agreed in the Condiciones Particulares. In bodily injury cases, the insurer is exempt if damage was solely due to the victim's own fault or unforeseeable force majeure unrelated to vehicle operation; vehicle defects and mechanical failures are not considered force majeure.

Property damage liability (compulsory + voluntary)

Mandatory coverage (Art. 23) covers property damage liability up to the legally regulated quantitative limits (€15,000,000 per accident, updated annually by European CPI). Voluntary liability (Art. 25) extends above the mandatory limit up to the amount in the Condiciones Particulares. Coverage applies when the driver is found civilly liable under Arts. 1,902 et seq. of the Civil Code and applicable motor traffic legislation. Excludes damage to the insured vehicle itself, objects transported in it, and property belonging to the policyholder, insured, owner, driver or their family members up to the third degree of consanguinity.

Legal defence and damage claim

Modalidad Sexta (Arts. 47–50) covers: criminal defence of the policyholder/owner/driver including attorney and court costs at insurer's expense; posting of bail bonds; claim for material and personal damages against responsible third parties including attorney fees; advance of accepted compensation up to €6,000 per claim. If the insured opts for free choice of attorney, reimbursement is capped at €1,200 per claim for defence/damage-claim fees and €300 for expert fees. Coverage is limited to Spain only.

International Insurance Certificate (Green Card)

The Green Card (Certificado Internacional de Seguro) is the document certifying that compulsory civil liability cover has been contracted. It is required to circulate in countries not party to the Multilateral Guarantee Convention (Inter-Bureaux countries). Coverage under the mandatory RC automatically extends through the Multilateral Guarantee Convention to all EEA states plus Andorra, Switzerland/Liechtenstein, Iceland, Norway, Croatia and Serbia. For Inter-Bureaux countries, the Green Card must be requested in advance.

Roadside assistance (Asistencia en carretera)

24-hour roadside assistance service available from km 0 anywhere in Spain. From abroad, assistance is available by calling +34 934 888 093 (24 hours). Coverage extends to Spain and Andorra at a minimum; European coverage is standard for the AXA Motor Elige product. If the tow truck takes more than 60 minutes, the insurer compensates the policyholder with €60 ("Compromiso Grúa").

Driver accident insurance (Seguro del Conductor)

Modalidad Quinta (Art. 44) covers the driver of the insured vehicle in the event of a traffic accident: (1) Death benefit – insurer pays the insured capital to beneficiaries (with a €5,000 advance for funeral expenses) if death occurs within one year of the accident; (2) Permanent invalidity – compensation based on capital × percentage per invalidity table (e.g. 100% for total paralysis, complete blindness, or permanent total incapacity; 60% right arm, etc.); invalidity cover does not apply to victims aged over 70; (3) Medical/pharmaceutical expenses up to €6,000 in freely chosen centres or up to €3,000,000 in concerted health centres, during the year following the accident. The insured capital (up to €50,000 for death/invalidity) is set in the Condiciones Particulares; the default entry level per the IPID is €15,000 (extendable to €30,000 or €50,000).

Passenger accident insurance

Excluded

The policy does not include a dedicated passenger accident coverage. Under the compulsory RC (Art. 23), passengers who are third parties (i.e. not the driver, policyholder, or close family members of these) are covered as injured third parties under the bodily injury liability coverage. However, there is no specific per-passenger accident capital or personal accident benefit for occupants beyond the mandatory RC indemnity. The driver accident insurance (Modalidad Quinta) covers only the driver. Family members of the policyholder/insured/driver are explicitly excluded as third parties under the voluntary RC.

Key conditions

Territorial scope

All coverages except Legal Defence: Spain, all EEA member states, and states party to the Multilateral Guarantee Convention (EU, Switzerland/Liechtenstein, Iceland, Norway, Andorra, Croatia, Serbia). Extension to Inter-Bureaux countries (outside Multilateral Guarantee Convention) requires the Green Card (International Insurance Certificate) to be carried. Legal Defence and Damage Claim coverage is limited to Spain only. Policyholder must have habitual residence in Spain; foreign trips may not exceed 60 days per trip.

Green card rules

The Green Card (Certificado Internacional de Seguro) certifies that compulsory civil liability cover has been contracted. It must be carried when driving in countries that have not adhered to the Multilateral Guarantee Convention (Inter-Bureaux countries). For all other countries covered by the Multilateral Guarantee Convention and the EEA, the standard policy certificate is sufficient. The Green Card must be requested from the insurer prior to travel.

Driver restrictions

Drivers under 26 years of age are excluded from voluntary civil liability coverage and own-damage coverage unless expressly designated in the Condiciones Particulares. If an unlisted driver under 26 is involved in a claim, the insurer may reduce its payment proportionally (Art. 9). Coverage is also excluded if the driver lacks a valid driving licence or has had their licence annulled or revoked (except for theft coverage). Driving under the influence of alcohol or drugs exceeding legal limits is an absolute exclusion for voluntary modalities; the insurer retains recourse rights against the driver. For compulsory RC, the insurer must still pay the victim but may seek recourse against the at-fault driver.

Claim notification deadline

The policyholder, insured or beneficiary must notify the insurer of any claim within a maximum of 7 days of becoming aware of it, providing all available information about the claim and its consequences (Art. 13). Failure to notify within this period may entitle the insurer to claim damages from the insured for the failure to declare; however, this sanction does not apply if it is proven the insurer had already become aware of the claim by other means. Sinister notification under Legal Defence must be made within 7 days of designation of any freely-chosen professional, always before the claim is resolved.

Bonus-malus rules

The policy applies a bonus-malus system based on the insured's claims history recorded in the SINCO file (national shared claims database). Premiums are adjusted at renewal according to the insurer's own bonus-malus table, which is communicated to the policyholder but is not published in the general conditions. Driving a vehicle by a person other than the declared main driver who, due to age or licence seniority, would have attracted a higher premium is treated as risk aggravation (Art. 9) and may result in proportional reduction of the insurer's payment. Bonifications may reach up to 60% for long no-claim histories; penalties apply following at-fault claims.
