MuKi Mutual Insurance Association (MuKi Versicherungsverein auf Gegenseitigkeit)
muki
muki is a motor third-party liability insurance for the Austria market with online purchase and 24/7 assistance.
Direct payment
The first or single premium (including fees and insurance tax) is due against handover of the policy and the payment request; follow-up premiums are due on the agreed main due date or the agreed instalment dates. Late payment of the first premium entitles the insurer to withdraw from the contract; late payment of a follow-up premium after a set grace period of at least two weeks can result in the insurer being released from its obligation to pay and in termination of the contract.
Geographic scope
Austria
Cover extends, unless otherwise agreed, to Europe in the geographical sense, and in any case to the territory of the states that signed the 30 May 2002 agreement between the national insurance bureaus of the EEA member states and other associated states (Green Card agreement area).
Unique selling points
- Selectable liability sums up to EUR 35 million, well above the Austrian statutory minimum.
- Unlimited premium-free claims bonus available in the Premium variant, so at-fault claims do not worsen the bonus-malus class.
- Optional EU-wide 24/7 assistance package (breakdown help, towing, replacement car) for about EUR 29 per year.
- No surcharge for paying the premium in instalments (monthly, quarterly or half-yearly), apart from the motor-related insurance tax.
- 10% discount for existing muki customers adding a vehicle to their policy.
Coverage limits
Bodily injury liability
€10,000,000 – €35,000,000
Covers justified third-party claims for bodily injury or death caused by use of the insured vehicle, up to the agreed lump-sum insured amount, which is shared with property and pure financial-loss claims (Art. 1 and Art. 6.1 AKHB). muki's Kfz-Haftpflicht Exklusiv product is sold in 'Standard' and 'Premium' variants and lets policyholders select an insured sum of EUR 10, 15, 20 or 35 million; the sources do not state which sums correspond to which named variant.
Property damage liability
€10,000,000 – €35,000,000
Covers justified third-party claims for damage to, destruction of, or loss of property (including pure financial loss) caused by use of the insured vehicle, sharing the same lump-sum insured amount as bodily injury cover (Art. 1 and Art. 6.1 AKHB). Selectable sums are EUR 10, 15, 20 or 35 million across the 'Standard' and 'Premium' variants of Kfz-Haftpflicht Exklusiv; the mapping of specific sums to variants is not stated in the sources.
Legal defence against unfounded claims
Covered
The policy covers the defence against unfounded third-party claims, including the related legal and out-of-court costs (Art. 1 AKHB; § 150 VersVG reproduced in the AKHB annex). These defence costs are counted against, and reduce, the same overall insured sum used for bodily injury and property damage (Art. 6.1 AKHB); no separate defence-cost limit is stated in the source.
Green Card / cover abroad
Covered
In states for which a Green Card (International Insurance Card) is issued, or for which its presentation has been waived under the 30 May 2002 inter-bureau agreement, cover extends at least to the scope prescribed for foreign-registered vehicles in that state, or to the contractually agreed scope if higher (Art. 5.1 AKHB). Cover under the Green Card ends when the policy itself ends, even if a longer validity is shown on the card (Art. 5.2 AKHB).
Assistance package (breakdown, towing, replacement car)
Optional
Optional add-on ('Assistance') available for an additional annual premium of approx. EUR 29, providing EU-wide help and assistance services including breakdown and towing help and a rental car in case the vehicle is disabled.
Driver personal accident
No limit stated
The AKHB liability terms for this MTPL product do not describe accident/injury benefits for the driver's own bodily harm; muki offers this separately as a distinct 'Kfz-Insassenunfallversicherung' (occupant accident insurance) product, which is not part of this MTPL policy.
Passenger personal accident
No limit stated
Transported persons are 'mitversicherte Personen' (co-insured persons) for liability purposes under Art. 2 AKHB, meaning they can claim against the policy if a third party (including the driver) is liable for their injury; however, no dedicated accident/injury benefit sum for occupants is described in the AKHB for this MTPL product. muki sells a separate 'Kfz-Insassenunfallversicherung' for this purpose.
Key conditions
Territorial scope
Cover applies, unless otherwise agreed, throughout Europe in the geographical sense and at least in the territory of the states that signed the 30 May 2002 inter-bureau agreement (see the AKHB annex list of signatory states); cover during waterborne transport of the vehicle is not interrupted if loading/unloading occurs within the territorial scope.
Green card rules
In countries where a Green Card is issued, or its presentation is waived under the inter-bureau agreement, cover applies at least to the scope prescribed locally for foreign-registered vehicles, or the contractually agreed scope if greater; cover ends with the end of the policy even if the Green Card shows a later expiry date; the insurer may recover costs it is obliged to pay abroad in situations where it would not be liable under the policy itself.
Driver restrictions
Cover requires the driver to be legally authorised to drive the vehicle and not impaired by alcohol or drugs under road traffic law, and the vehicle must not carry more people than legally/contractually permitted (Art. 9.2 AKHB); breach can trigger the insurer's release from the duty to pay, except towards the policyholder/co-insured persons who could not, without fault, recognise the breach. Marketing materials further state muki does not accept drivers under 21 (or second drivers under 21), accepts mopeds from age 15 (single/two-seater only) and motorcycles from age 21.
Claim notification deadline
In case of personal injury, help must be given (or arranged) immediately and the nearest police station notified at once; the insurer must generally be notified within one week of the policyholder becoming aware of the insured event, a third-party claim, or related administrative/court proceedings (Art. 9.3 AKHB); late notification can be cured without loss of cover if the policyholder has already compensated the damage within four weeks and completes notification within six months of the event.
Bonus-malus rules
Where premium is based on claims history (bonus-malus), the policyholder must be informed of how the system works before concluding the contract, and the insurer must issue a claims-history certificate on request (Art. 15 AKHB; § 16 KHVG). muki also offers an internal transfer of bonus-malus classification from a previous insurer under specific conditions (same policyholder, no pending claims, minimum 2 years with the previous insurer, no association malus penalty from level 10 upward).
