Direct payment

As liability insurance, the insurer settles justified claims directly with the injured third party and defends unfounded claims raised against the policyholder or co-insured persons; the insurer is authorised to make all declarations it deems appropriate in the policyholder's name to satisfy or reject the injured party's claims.

Geographic scope

Austria (nationwide)

Coverage applies to Europe in the geographical sense, and in any case to all states that signed the 30 May 2002 agreement between national insurance bureaus of the EEA member states and other associated states; Iceland, Greenland, Spitsbergen, the Canary Islands, Madeira, Cyprus, the Azores and Asian Turkey are excluded from the 'Europe' definition used for the underlying policy conditions.

Coverage limits

Bodily injury liability

€7,790,000 – €30,000,000

Austrian MTPL uses a single combined lump-sum (Pauschalversicherungssumme) covering both bodily injury and property damage per claim. The statutory minimum is EUR 7,790,000; policyholders may choose a higher voluntary sum of EUR 9,000,000, 12,000,000, 16,000,000, 20,000,000 or 30,000,000. A separate statutory sum applies additionally for pure financial losses that are neither bodily injury nor property damage, per § 9(5) KHVG.

Property damage liability

Property damage is covered under the same combined lump-sum (Pauschalversicherungssumme) as bodily injury, ranging from the statutory minimum of EUR 7,790,000 up to a voluntary maximum of EUR 30,000,000 (intermediate options: 9,000,000 / 12,000,000 / 16,000,000 / 20,000,000). A separate statutory sum applies additionally for pure financial losses per § 9(5) KHVG.

Defence against unfounded claims

Green Card / international insurance card

Covered

In states for which a Green Card is issued, or for which the 30 May 2002 agreement between national insurance bureaus waives its presentation, cover extends at least to the scope prescribed for foreign-registered vehicles in that state, or the scope agreed in the policy if higher; cover ends with the end of the insurance contract even if a longer duration is shown on the Green Card. The insurer's website also allows customers to request a Green Card.

Key conditions

Territorial scope

Cover applies to Europe in the geographical sense unless otherwise agreed, and in any case to the territory of states that signed the 30 May 2002 agreement between national insurance bureaus of EEA member states and other associated states.

Green card rules

In the territory of states for which a Green Card is issued, or for which its presentation is waived under the 30 May 2002 agreement, cover extends at least to the scope prescribed for foreign-registered vehicles in that state, or the agreed contractual scope if higher; cover always ends with the end of the insurance contract regardless of any longer duration shown on the Green Card.

Driver restrictions

The driver must be legally entitled to drive the vehicle and must not be impaired by alcohol or drugs under road traffic law; the vehicle must not carry more persons than legally permitted, and agreed conditions on vehicle use must be observed.

Claim notification deadline

The policyholder must notify the insurer of the claim, any claim raised by the injured third party, and the initiation of related administrative or court proceedings within one week of becoming aware of them; failure to comply can lead to full or partial loss of cover.

Bonus-malus rules

For passenger and combination vehicles, premium is set under a 18-level bonus/malus scale (0-17, from 45% to 200% of tariff premium) based on claims history over an observation period from 1 October to 30 September; a new contract starts at level 9 unless a prior claims history is carried over. A claim-free observation period (minimum 9 months, or 6 months if starting at level 9) lowers the premium by one level; each claim charged to the insurer raises it by three levels at the next main due date.
