Defence of unjustified claims

Where claims exceed the insurance sum, litigation costs are borne proportionally to the insurance sum relative to total claims.
Green Card / International Insurance Certificate
Covered
Coverage extends automatically to all Green Card signatory states. In each visited state, the insurance applies at least to the locally prescribed minimum cover for foreign-registered vehicles, but no less than the contractually agreed sum. The insurer may issue an International Insurance Certificate (Green Card). Coverage expires at policy end even if the Green Card shows a later date.

Driver accident / personal accident for driver
Excluded
Personal accident cover for the driver is not included in the MTPL policy. It is available as a separate optional product (Auto & Frei Lenkerschutz / Insassenunfallversicherung).
Passenger accident cover
Excluded
Passenger accident cover is not part of the MTPL base policy. Passengers may be covered as third-party beneficiaries under the liability section for claims arising from the driver's fault. A separate optional passenger/driver accident product (Lenkerschutz) is available.
Key conditions
territorial_scope
Coverage applies throughout Europe in the geographic sense, and in any case in all states that have signed the Green Card Agreement of 30 May 2002 (see annex to ABKH 2019). The territorial scope may be extended by contract. Coverage is not interrupted during water transport of the vehicle if loading/unloading ports are within the territorial scope; coverage ends upon loading completion if the destination is outside the scope (Art. 4 ABKH 2019).
green_card_rules
In Green Card signatory states, the insurance applies at minimum to the locally prescribed cover for foreign-registered vehicles but at least the contractually agreed sum. Coverage expires at policy end even if the International Insurance Certificate (Green Card) shows a later date. If the insurer is obligated to pay under foreign law but not under the policy, the insurer has the right to claim reimbursement from the policyholder (Art. 5 ABKH 2019).
driver_restrictions
The driver must be legally authorised to drive the vehicle (valid driving licence). Driving under the influence of alcohol or drugs (as established by a final administrative or judicial decision) gives the insurer the right to claim back payments made. If the driver lacks a valid licence or drives under the influence, the insurer's liability towards the policyholder and other insured persons (other than the driver) remains in force if the breach was not recognisably their fault. Agreed restrictions on vehicle use must be observed (Art. 9 ABKH 2019).
claim_notification_deadline
The insurer must be notified within one week of becoming aware of: (1) the insured event, (2) a claim by an injured third party, (3) initiation of any related administrative or judicial proceedings. In case of bodily injury, the nearest police station must be notified immediately and assistance rendered. Claims by the injured party must not be acknowledged without the insurer's consent. The insurer must be allowed to conduct the legal defence (Art. 9 ABKH 2019).
bonus_malus_rules
The premium is calculated based on the claims history using a statutory bonus/malus scale (Art. 15 ABKH 2019). Starting level is stage 9 (110% of tariff premium). Each claim-free observation period (1 Oct–30 Sep) moves the policyholder one stage towards bonus; each at-fault claim moves the policyholder three stages towards malus. The scale ranges from P5 (42% of tariff) to stage 17 (200% of tariff). Claims history certificates are issued upon request per § 16 KHVG. Optional Freischaden add-on allows one claim to be settled without bonus/malus downgrade.
