Direct payment

The insurer is obliged to, without delay, and no later than 60 days from receipt of the claim, determine the validity and amount of the claim and provide the injured person with a written decision. The insurer must pay the determined compensation or undisputed amount as an advance payment within 15 days of sending the reasoned offer or substantiated response, and no later than 60 days from receipt of the claim. In the event of failure to pay within the prescribed period, the injured person is also entitled to interest from the date the claim was submitted.

Bodily injury liability (per event)

Covered

Covers bodily injury, health impairment and death of third parties caused during use of the insured vehicle. The insured sum of 6,467,317.01 EUR per event applies to all personal injury claims regardless of the number of injured persons.

Covers destruction or damage to property of third parties caused during use of the insured vehicle. The insured sum of 1,304,001.59 EUR per event applies to all property damage claims regardless of the number of damaged items.

Legal defence costs

Covered

The insurer covers the costs of defending the insured in criminal proceedings only when the insurer has explicitly given consent for the defence attorney and committed to covering the costs. The insurer is also authorised to make all statements on behalf of the insured deemed necessary for resolving a claim or defending against unfounded claims.

Green Card (International Motor Insurance Certificate)

Covered

Insurance cover extends to the territory of the Republic of Croatia and to the territories of member states of the Green Card insurance system. If a Green Card member state where the loss occurred requires a higher minimum insured sum than Croatia's minimum, the insurer is obliged to provide cover up to that state's minimum insured sum.

Driver accident coverage

Excluded

The driver of the vehicle that caused the damage is explicitly excluded from claiming compensation for their own death or bodily injury under the compulsory MTPL policy. An optional accident insurance add-on (Auto nezgoda) can be purchased separately, covering death and permanent disability for the driver and passengers.

Passenger accident liability

Covered

Damage to passengers in the vehicle that caused the accident (death, bodily injury, health impairment, destruction or damage to property) is covered under the compulsory MTPL policy, subject to the standard insured sums and exclusions. Passengers who voluntarily boarded an unregistered, uninsured, or unauthorised-driver vehicle may be excluded if the insurer proves they were aware of those circumstances.

territorial_scope

Cover applies to the territory of the Republic of Croatia and to all member states of the Green Card insurance system, unless otherwise agreed. Where a Green Card member state prescribes a higher minimum insured sum than Croatia's statutory minimum, the insurer provides cover up to that state's minimum.

green_card_rules

The Green Card (international motor insurance certificate) serves as proof of compulsory MTPL cover in Green Card member states. Cover automatically extends to those territories. If the host country's statutory minimum exceeds Croatia's minimum, the insurer adjusts cover accordingly.

driver_restrictions

The insured loses rights under the policy if: the driver did not use the vehicle for its intended purpose; the driver lacked a valid driving licence of the appropriate class/category; the driver's licence was revoked or the driver was excluded from traffic or subject to a prohibition order; the driver operated the vehicle under the influence of alcohol (0.5‰ or more), drugs, or psychoactive substances; the driver left the scene of the accident before completing the European Accident Report or notifying police; the damage was caused intentionally; the vehicle was in a technically defective state known to the driver; or damage arose from the criminal offence of reckless driving for which a final judgment has been issued. In cases of intentional damage or reckless driving, the insured must reimburse the full amount paid by the insurer including costs and interest; in other cases reimbursement is capped at 12 average net wages.

claim_notification_deadline

The insured is obliged to notify the insurer of the loss event within three days of the event and provide truthful and comprehensive information about the course of the accident and its circumstances. If a claim, lawsuit, or request for evidence preservation is filed against the insured, they must notify the insurer within three days of receiving the relevant documentation. If the insured receives a claim demand, they must immediately notify the insurer.

bonus_malus_rules

The insurer determines the premium using data from the Croatian Insurance Bureau database, including reported claims under compulsory MTPL policies. If a vehicle has been insured for at least one year with no reported claims, the insured receives one premium grade lower (bonus), up to grade GS9. For each reported claim, regardless of the duration of insurance, the premium grade increases by three grades (malus), up to grade 18. The base (neutral) grade is 10, corresponding to 100% of the base premium. The bonus scale ranges from GS9 to GS1 (40%–47.5% of base premium) and the malus scale from grade 11 to grade 18 (115%–250% of base premium). No surcharge applies for instalment payment. Bonus transfer from abroad is possible based on a claims history certificate no older than 6 months, accepted in original in English or German.
