Direct payment

The Company may, at its own option, take over and conduct in the name of the Insured the defence or settlement of any third-party claim, and will pay all costs, interest and expenses incurred with its written consent, including claimant's costs, interest and expenses forming part of the indemnity to third parties.

Geographic scope

Republic of Cyprus (territory under effective government control), extendable to EU Member States and other countries via endorsement

Cover applies within the territory of Cyprus excluding areas where the Government of the Republic of Cyprus does not have effective control. Cover automatically extends to the territory of EU Member States applying Compulsory Third Party Liability Insurance, provided those States have countersigned the Multilateral Guarantee Agreement. Cover for other States where Foreign Bureaux of International Insurance are registered under the Uniform Agreement (Green Card system) applies only subject to a relative Endorsement issued by the Company.

Legal Representation and Defence

Green Card / International Motor Insurance Card

Breakdown and Road Assistance

Endorsement No. 120 extends the Policy to include Breakdown and Road Assistance services provided by an independent Sub-Contractor while the Insured Motor Vehicle is found on a 'Road'. Details of the services, terms and conditions are given to the Insured separately. Eurosure and/or its Managers and/or Insurance Intermediaries accept no liability for the acts, errors, omissions or negligence of the Sub-Contractor providing this service. This Endorsement applies only if indicated in the Policy Schedule.

Personal Accident Cover to the Authorised Driver

€4,500

Endorsement No. 101/101X indemnifies any Authorised Driver, on a scale of benefits (100% for death, permanent total disablement, or loss of sight in both eyes; 50% for loss of sight in one eye, etc.), for death or bodily injury sustained on a 'Road' while driving the insured Motor Vehicle, up to the Limit stated in the Schedule. The Proposal Form's suggested default limit for the Third Party Liability policy is €4,500 (compared to €4,500 for Third Party Fire & Theft/Comprehensive, €9,000 for Comprehensive Silver, and €26,000 for Comprehensive Gold). No indemnity applies if the driver is under 18 or over 70, or if the accident is linked to intoxication, suicide or intentional injury. This benefit applies only if the relevant Endorsement is indicated in the Schedule.

Indemnity to Passengers (Third Party Liability Extension)

Endorsement No. 3 extends the indemnity under 'Liability to Third Parties' to cover any passenger or other person (other than the driver) carried in, entering or alighting from the Motor Vehicle, against sums they become legally liable to receive for bodily injury, death, emergency treatment or property damage, in consideration of payment of an Additional Premium. General Exception No. 7 (which otherwise excludes persons in/entering/leaving the vehicle) is deleted once this Endorsement is issued. Without this Endorsement, passengers are not indemnified under the base Third Party Liability cover.

Territorial scope

Covers use of the Motor Vehicle within Cyprus (excluding areas outside effective government control); automatically extends to EU Member States applying Compulsory Third Party Liability Insurance where the Multilateral Guarantee Agreement has been countersigned; extends further to other States registered under the Uniform Agreement (Green Card system) only if a relative Endorsement has been issued by the Company.

Green card rules

For States that have signed the Multilateral Guarantee Agreement, the greater of the Policy's indemnity or the minimum required by that State's law applies automatically, without need for a physical Green Card. For States outside this Agreement where a Foreign Bureau of International Insurance is registered, cover applies only if the Company has issued the relative Endorsement, in consideration of an Additional Premium, and indemnity is limited to the minimum required by that State's law.

Driver restrictions

Standard Endorsements 9/9A exclude liability while the vehicle is driven by, or in the custody of, any person under 23 (or 25, depending on the Endorsement issued) or over 70 years of age, or who holds a Learner's Driving Licence or has held a Full Driving Licence for less than two consecutive years, unless approved in writing by the Company. Endorsement 131 further restricts learner drivers aged 17.5-18 or over 18 unless accompanied by a qualifying 'co-driver' meeting minimum age and licence-experience requirements; no cover applies to passengers other than the co-driver while a learner driver is at the wheel.

Claim notification deadline

The Insured must give notice of any occurrence which may give rise to a claim to the Company as soon as possible/immediately, with full particulars; every letter, claim, writ, summons and process must be forwarded to the Company immediately on receipt. The Police must be notified immediately of any accident or criminal act (e.g. theft) that may give rise to a claim; failure to do so voids liability under the Policy.

Bonus-malus rules

Under Endorsement No. 130 ('Protection - No Loading Due to a Claim'), no additional premium is charged following submission of a claim under the Third-Party Liability Cover unless more than one claim is submitted within any consecutive two-year period. If more than one claim is submitted in such a period, an additional premium (loading) is charged based on all claims except the one with the lowest paid/estimated amount.
