Direct payment

For certain damage claims the insurer may settle directly with the approved repairer instead of reimbursing the policyholder, subject to prior agreement; under the mechanical-breakdown option and the glass-breakage zero-deductible option, the policyholder can also choose to pay the garage directly and be reimbursed, or have the insurer pay its share directly to the repairer.

The vehicle is declared a total loss when repair costs exceed its expert-assessed value, in case of theft, or when it is technically unrepairable. Indemnity is based on the vehicle's replacement value (or, for vehicles under 12 months old, the original purchase price) at the day of the loss, less the applicable deductible; ownership of the vehicle transfers to the insurer upon payment.

Theft and attempted theft cover

Glass breakage cover

Covered

Covers the cost of repair or replacement of the windscreen, rear window, side windows, front optical units and indicators listed in the manufacturer's catalogue, and, if made of glass or translucent material, the sunroof and headlight covers, when damaged by accidental breakage. Rear-view mirrors, rear lights/indicators, and simultaneous breakage of several glazed elements are excluded (the latter is covered under Dommages Tous Accidents instead). An optional zero-deductible add-on is available.

If a damage guarantee has been subscribed, covers direct damage caused to the vehicle by hail, flooding, ground movement or subsidence, mudslides, or avalanche not officially classified as a 'Catastrophe Naturelle', as well as damage from events officially recognised as 'Catastrophes Naturelles' by inter-ministerial decree. The natural-disaster guarantee can only be triggered after publication in the Official Journal of the decree recognising the state of natural disaster, and the deductible is set and revised by the public authorities.

Replacement vehicle cover

Reserved for policyholders aged 21 or over holding a driving licence for at least 2 years. Under the 'Tous Risques' formula, this benefit is only granted if it is expressly mentioned in the personal conditions; it is automatically included under the 'Tous Risques Maxi', 'Tiers + bris de glace + vol' and 'Tiers + bris de glace' formulas. A category A or B replacement vehicle is provided for up to 8 consecutive days when the vehicle is immobilised for more than 24 hours in France for repairs requiring at least 5 hours of labour following an accident or attempted theft, or in the event of theft. The optional Assistance Intégrale/Maximale upgrades extend this to up to 21 days (accident/attempted theft) or 40 days (theft not recovered), up to €3,000 TTC.

Driver protection (bodily injury) cover

Only in Tous Risques, Tous Risques Maxi

Indemnifies the driver's bodily injury under common-law liability rules when the driver is involved in an accident, fire or explosion involving the insured vehicle. Only compensated if the resulting permanent functional impairment exceeds 9%, or in the event of death (benefiting the driver's heirs); temporary loss of professional income is compensated from the 31st day of work stoppage for up to 300 days. The overall ceiling is stated in the personal conditions; the insurer's own marketing material indicates ceilings of €400,000 under the Tous Risques formula and €800,000 under the Tous Risques Maxi formula.

Key conditions

Driver age and experience limit

Certain benefits (e.g. replacement vehicle, Option Assistance upgrades) are reserved for policyholders aged at least 21 with a driving licence held for at least 2 years; drivers holding a licence for less than 5 years are subject to a policy-defined penalty if a minor drives the vehicle without the policyholder's knowledge; supervised/accompanied driving from age 15 is accepted if declared to the insurer.

Repair network requirements

Policyholders have the free choice of the repair professional to whom they entrust their vehicle, in accordance with Article L.211-1 of the Code des Assurances (no mandatory approved-garage network for repairs); certain assistance and mechanical-breakdown services are organised by the insurer's assistance partner, Opteven Services.

Territorial scope

Responsabilité Civile and Défense Pénale et Recours Suite à Accident apply in Metropolitan France, Monaco and countries party to the inter-bureaux Green Card Convention; other damage guarantees apply in Metropolitan France and Monaco, extended to Green Card countries for trips of under 91 consecutive days; personal assistance applies worldwide for trips of up to 90 consecutive days, while vehicle assistance applies in Green Card countries.

Anti-theft requirements

Any anti-theft devices or vehicle marking (tattooing) required under the personal conditions must be evidenced by a purchase receipt in the event of a theft claim, together with an immediate police report and the vehicle roadworthiness-inspection report. Theft cover excludes losses facilitated by keys left in, on or under the vehicle, theft or attempted theft using presumed false (non-manufacturer) keys, theft where keys are stolen from a dwelling without forced entry, and theft or attempted theft committed by the policyholder's employees or household members or with their complicity.

Claim notification deadline

Claims must be reported within 2 business days for theft or attempted theft, within 30 days of publication in the Official Journal of the inter-ministerial decree for Catastrophes Naturelles claims, and within 5 business days for all other cases; late reporting causing prejudice to the insurer can result in forfeiture of cover for that claim.

Deductible rules

Deductible (franchise) amounts for each damage guarantee are stated in the personal conditions. Optional add-ons can modify the deductible: 'Option zéro Franchise Dommages' removes the deductible for theft, fire, accidental damage and terrorism claims (excluding Catastrophes Naturelles, natural forces, storm and glass-breakage deductibles, which remain payable); 'Option zéro Franchise Bris des glaces' removes the glass-breakage deductible, subject to prior acceptance for direct payment of the service provider; 'Option Franchise Dommages Majorée' increases the deductible on the same guarantees.
