Direct payment

The injured party submits the claim directly to the insurer of the vehicle responsible for the accident, either in person at insurer branches or by email. The insurer offers a choice of settlement methods for property damage (with repair invoice or without repair invoice), must issue a reasoned offer or a justified reply within 60 days of receiving the claim, and must pay the offered amount within 15 days of sending the reasoned offer.

Bodily injury liability

The MTPL Terms defer the sum insured to the Compulsory Insurance in Traffic Act (Art. A.1.1). The statutory minimum sum insured for death, bodily injury and health damage is EUR 6,450,000 per event regardless of the number of injured persons, or EUR 1,300,000 per injured person.

Handling and rejection of third-party claims

Territorial scope

Insurance protection applies to the territory of the Republic of Croatia and, via the Green Card, extends to Green Card System member states.

Green card rules

The Green Card is issued by the insurer as proof of the existence of compulsory MTPL insurance and is recognised in all Green Card System member countries.

Driver restrictions

The policyholder loses rights under the insurance if, at the time of the accident, they were driving under the influence of alcohol with a blood alcohol content of 0.5 g/kg or more, or refused to undergo testing for alcohol, drugs, psychoactive medication or other psychoactive substances.

Claim notification deadline

It is recommended to submit the claim as soon as possible. The insurer must deliver a reasoned offer for compensation or a justified reply within 60 days of receiving the claim, and must pay the offered amount within 15 days of sending the reasoned offer.

Bonus-malus rules

Policies are classified into bonus/malus grades based on claims history and reclassified annually on 1 January. With a claims-free history, discounts of up to 74% can be achieved; a reported claim moves the contract to a less favourable grade the following year, unless optional Bonus Protection has been arranged, which forgives one reported claim per calendar year regardless of its type or amount.
