Territorial scope | Coverage applies within the geographical borders of Europe and extra-European territories belonging to the European Union. When abroad, at least the legally required minimum coverage of the visited country applies at all times. If an international insurance certificate (green card) is issued, coverage also applies to the countries listed and not crossed out on that card. | MTPL cover applies throughout the geographical limits of Europe and to extra-European territories belonging to the European Union. The minimum coverage in each country corresponds to that country's statutory minimum; the policyholder always retains at least the contractually agreed cover. | Cover applies within the geographical boundaries of Europe and in non-European territories belonging to the European Union. For non-European countries, cover is confirmed only via the International Green Card. In EU/EEA countries, the Kfz-Umweltschadenhaftpflicht applies only where the EU Environmental Liability Directive (2004/35/EC) applies. If a higher mandatory level of cover is required abroad, ERGO provides that higher level. | MTPL coverage applies within the geographical borders of Europe and the non-European territories belonging to the European Union. In the visited country, the legally prescribed scope of insurance applies, but at minimum the scope agreed in the policyholder's own contract. With the Green Card, coverage extends to listed non-European countries, but the maximum payment is limited to the locally applicable statutory minimum sums in the country of visit (clause A.1.4). |
Green card rules | The international insurance certificate (green card) is available digitally in the customer account and can be downloaded and printed. In EU member states and countries such as Switzerland, carrying the green card is not mandatory. However, it must be carried in certain countries (e.g. Turkey, Serbia, Russia, Albania, Belarus, North Macedonia, Moldova, Montenegro and Bosnia-Herzegovina). | If Debeka issues an International Motor Insurance Certificate (Green Card), MTPL cover additionally extends to the non-European countries listed thereon that are not crossed out. The scope of cover in those countries corresponds to A.1.4.1 sentences 2 and 3 (host-country minimum / contractually agreed minimum). | ERGO issues an International Green Card (Internationale Grüne Versicherungskarte) confirming MTPL cover for the non-European countries listed on the card. Countries crossed out on the card are excluded. The card is required as proof of cover when travelling in countries that are not members of the European Green Card system. Within the geographic boundaries of Europe, cover applies automatically under the policy without presentation of the Green Card. | The insurer issues the Green Card upon request. If issued, the coverage extends to non-European countries listed on the card, provided the country name is not crossed out. Maximum payment in those countries deviates from the contractual sums and is capped at the local statutory minimum amounts applicable in the country of visit (clause A.1.4.2). |
Driver restrictions | The vehicle may only be used by an authorised driver (a person using the vehicle with the knowledge and will of the entitled party). The policyholder must not knowingly allow the vehicle to be used by an unauthorised driver. The driver must hold the required driving licence. Driving under the influence of alcohol or drugs is prohibited. | Only authorised drivers may use the vehicle; authorised means driving with the knowledge and will of the person entitled to dispose of the vehicle. The driver must hold the required driving licence for use on public roads. The policyholder must not knowingly permit use by an unauthorised driver or a driver without the required licence. | The MTPL cover applies to the policyholder and all additionally insured persons (mitversicherte Personen) including the vehicle owner, holder, driver of the insured vehicle, certain co-drivers in an employment relationship, the employer if the vehicle is used for official purposes with the policyholder's consent, and holders/owners/drivers of insured trailers or towed vehicles. Only authorised persons may use the vehicle (those using it with the knowledge and will of the entitled person). The driver must hold the required driving licence. The policyholder, holder and owner must not knowingly allow an unauthorised person to use the vehicle. Driving under the influence of alcohol or narcotics is an obligation breach that may result in reduction of up to EUR 5,000 of the insurer's recourse against the policyholder. | The vehicle may only be used by an authorised driver, i.e. a person who uses the vehicle with the knowledge and consent of the person entitled to dispose of it. The policyholder, registered keeper and owner must not knowingly permit use by an unauthorised driver. The driver must hold the required driving licence for use on public roads (clauses D.1.1.2, D.1.1.3). |
Claim notification deadline | An insurance claim (loss event) must be reported to the insurer within one week of occurrence. If claims are asserted against the policyholder judicially or extra-judicially, these must also be notified within one week of assertion. The insurer must be granted conduct of any litigation and may appoint a lawyer in the policyholder's name. | Every loss event that may give rise to a claim must be reported to Debeka within one week (E.1.1). Third-party claims asserted out of court must also be notified within one week (E.2.1). Judicially or officially asserted claims must be notified immediately (E.2.3). | The policyholder must notify ERGO immediately (unverzüglich) of any loss event that may lead to a claim. For extrajudicial claims asserted against the policyholder, notification must occur within one week of the claim being made. Court proceedings (e.g. lawsuit, payment order) must be reported without delay. For property damage likely not exceeding EUR 500, the policyholder may settle directly; if unsuccessful, ERGO must be informed without delay. In case of theft, fire or animal collision, the police must be informed immediately and ERGO notified. | Each claim event that may give rise to a payment must be notified to the insurer within one week (clause E.1.1.1). If a third party asserts a claim out of court, this must be reported within one week of the claim being raised (clause E.1.2.1). Court proceedings (e.g. lawsuits or payment orders) must be reported immediately (clause E.1.2.3). In the event of vehicle theft or loss of vehicle keys, police must be notified immediately. |
Bonus malus rules | Premiums in MTPL are based on the no-claims discount class (Schadenfreiheitsklasse, SF-Klasse). Classification is based on claims-free years and claims history. Each claims-free calendar year improves the SF-class by one level; claims result in downgrading per the tables in the Appendix. The SF-class lapses if cover is interrupted for more than ten years. An optional no-claims protection (Rabattschutz) add-on is available (from SF-class 4), which prevents downgrading for one claim per calendar year. | SF-classes apply in the MTPL and comprehensive (Vollkasko) insurance. Contracts are reclassified annually on 1 January based on the claims history of the preceding calendar year. A claims-free year results in promotion to the next better SF-class; each chargeable claim causes demotion according to the tables in Annex 1. Rabattschutz (discount protection) keeps the SF-class unchanged for one chargeable claim per calendar year; requires a minimum SF-class 4 and can only be cancelled at the end of the insurance year. | Premiums for MTPL and comprehensive (Vollkasko) are calculated on the basis of uninterrupted claim-free years (Schadenfreiheitsklassen, SF-Klassen). For motorcycles/scooters the scale runs from class M (new/claim-affected, 155% base rate in MTPL) through 0, SF 1/2, SF 1 to SF 20+ (24% in MTPL). Each claim-free calendar year advances the contract one class in the progression table. If a claim is recorded, the contract is downgraded according to the regression tables (Rückstufungstabellen). For motorcycles, one claim from SF 1–7 in MTPL typically results in regression to SF 1/2. For the Smart tariff, the regression is steeper than for the Best tariff. Voluntary repayment of a settled claim prevents downgrading in MTPL. An optional Rabattschutz (available in Best tariff only) protects the SF class after one claim per calendar year. | The contract is classified into no-claims bonus classes (SF-Klassen) for both MTPL and comprehensive insurance. Classification is reviewed annually on 1 January. A claim-free year leads to advancement to the next better class; a claim-burdened year results in downgrading according to the tables in Appendix 1. For passenger cars, SF-classes range from SF 35 (20% rate) to M (135% rate). An optional Rabattschutz (bonus protection) prevents downgrading on the first claim within a calendar year in MTPL and comprehensive. If Rabattschutz is agreed, the SF-class is maintained in the following year even after a claim, up to a maximum of three claims during the entire Rabattschutz period; after the third claim, the Rabattschutz arrangement terminates for both covers (clauses I.1–I.5, I.3.3). |
